I think this is total BS as well. Last winter my buddy was helping a lady who broke down on the side of the highway. He was looking underneath the hood when the ladies Accord was rear ended by a 2012 A6. He suffered a broken hand and some bumps and bruises, but nothing that wouldn't heal. The lady had rink dink insurance and the Audi had state farm. He instantly lawyered up and went through therapy etc. Ended up suing both insurance companies. He got his medical bills paid and about $10k. Honestly that was more than fair. He wore cast on his left hand that he probably didn't even need for 3 weeks. He's a student so he didn't loose any money. Also knew a guy who got $6k for whiplash, though and don't know the details of his story to well.

$100k lol. This sounds like the dreams of a broke college student who wishes he could move off campus and drive a skyline to class to impress some bish. Sorry if that sounds harsh, just my opinion. What exactly would a judge be compensating you for by ordering them to pay you $100k dollars?
Uh...everything about it? Not to mention the needless showboating where he's trying to make a point that has no substance to even be considered valid. All I got out of that was pure jealousy.

You're a poor college student that drives around a $2,500 E30. You probably live in a fairly low class apartment.

You've clearly gone though some troubles in life, either due to bad luck, or poor decisions. But you're looking past that, and looking towards the future.

Now you have a rather large sum of cash given to you.

We're all car guys on this site.

You can't tell me you aren't going to spend that on a decent ride. $25,000 is a little high, but the he can do what he likes.

I say go for it. Live a little and have some fun.

I was actually approached by an attorney at the courthouse during my small claims litigation being that he was in the courtroom during the initial proceedings. He grabbed me after the initial court date and told me he could get me 10x what I wanted. I laughed in his face and told him to get a job.

Lol @ jealousy being that one of the cars he wants to buy with his $$ is one I currently own. My route was longer, harder and I GUARANTEE paid off 10x fold.

If you think the BIG picture is teaching Les Schwab a lesson..you are so off. The BIG picture is that this country is in the shitter because of shit like this. People getting $100,000 for $2500 in damage and "what could of happened".

Opinions are just like ass holes right? This is just mine...

I'm sorry but your car is worth closer to the $500 they offered you than it is the $100,000 your looking to get. I had the EXACT same thing happen to me and I sued in small claims court for what I was out. I didn't attempt to hit the lotto. I investigate collisions and have been to civil depositions and I would be AMAZED if you got 100k. People don't get awarded money for "what could of happened" Property damage only collisions don't get 100k. Injuries and mental shit get that kind of money, but I wouldn't be surprised if your attorney is having you got the the chiropractor for "deep tissue damage" and the psychiatrist for "mental anguish". Maybe I'm biased because I see REAL collisions every day with REAL injuries and to see someone try to get rich off such an accident where they suffered maybe $2500 in damage makes me fucking sick. All you guys that thinks this is ok, don't bitch when you get a high insurance quote because WE are all the ones paying for bullshit like this.

Do I think the shop should get off? Nope, sue them for what your out + a bit for inconveniencing you. But to buy a house, car and savings. Wow, what a joke.

My car is at a shop right now. If I drive it home and it catches on fire I'm going to expect compensation for the vehicles worth. Not because "I could have died". Not because the shop gave me a offer I didn't like or attempted not to take responsibility. I just love this AMERICAN concept where if someone acts unreasonable you act 100x more unreasonable to teach them a lesson. Lol

Don't even get me started on personal injury attorneys. Its not called whiplash any more. Its called whipCASH.

So principle depends on your financial situation. Got it! Thanks

We just differ on what each of our principles are that's all. I just dont believe that it is ok to accept that much $$ for what occurred. A $2500 damaged + a companys bad attitude = $100,000? (op's words) If I did that my family would be ashamed of me. But again I guess people are just different. Either way you cant post on a public forum and not think you wont catch some flak.

Then i see the op making comments about houses, cars "treating himself to a nice apartment" etc etc. For what? Cause his wheel came off and his car was damaged? I am blown away how people think that is REASONABLE? I just dont get it...never will.

I gave them a cheap and easy way out. No lawyer, no courts, no crazyness. Just cut me a check with a fair amount that will get my car fixed. I'm not claiming it was a near death experience. I've been shot, hit by a car, in a car going 190MPH when it wrecked, I've been stabbed and severely beaten. I've had near death experiences, and this was not one of them. waffleswaffleswaffleswaffleswaffles? Shut the fuck up. I was reasonable. I gave them an out. They decided to be dicks.

The offer came in 45 minutes ago. I'm not allowed to disclose the exact number for legal reasons, but lets just say that you're wrong, and I'm right. Even after my attorney takes his cut, I'm right.

I was checked out by doctors. I'm fine. We aren't claiming any of that shit.

I'm going to buy a car. Not a Ferrari, or an Aston Martin. I found an R32 GTR for $27K, and an NSX for $22K. Failing that, maybe a $15K Evo, or an E30 M3 would work. I'm not buying a house, but I'm going to treat myself to one of the nicer apartments up by campus. Its not a luxury pad or anything, but its nice enough and has a great view of the water. And I'm not buying, I'm renting. The rest will go to pay for school, and into my savings account. I think that's a pretty effective use of my windfall. I work hard, in school and at work. I run my own small business on the side. This might let me turn that into a full time gig because I can take the risk with this security net in my savings account.

In summary, fuck you. I gave them an easy and cheap way out. All I wanted was a couple of new body panels and some paint along with a handshake and an apology. They treated me like shit. The manager swore at me, and tried to blame me for what happened to my "piece of shit kraut mobile." He forced me to get a lawyer involved.

I'm in the hospital for another, totally unrelated thing, and I'm on a shit load of painkillers via IV, so if any of this makes absolutely no sense, that would be why.
First off I think you are full of shit because ANY settlement would be accompanied by a cease and desist clause which would bar you from any activity which pertains to the alleged action which the settlement was based on. IE being on here talking about it...

Or maybe the Les Schwab attorney are idiots and did not include that in the agreement. Which is damn near impossible considering the only reason to settle is so that such an event would not become public which would be detrimental to their brand. IE what you are doing here and now...

So you have been shot, stabbed and beat nearly to death?? Either you have the worst luck in history or you have not made some bad decisions in life. Now that you have your $$ you are looking at buying Skylines and NSX's lol. My god you are the epitome of everything im talking about. lol.

    Either way, enjoy. :D

Lawyer gets at least 30% of that, so take the hypothetical $100,000 and drop it down to $70,000 right there, then other assorted fees for the legal counsel, and I'd say $65,000 or less. So, even at this hypothetical $100k, you end up after all is said and done somewhere more likely around ten times the value of a clean, sorted e30. Is that a chunk of change, yes. Is anyone getting rich, no.

My biggest issue at the end of the day, is it sounds like the OP already has his plans, and sounds like he is gonna blow his wad quick. If I were in his boat, I'd buy another replacement e30, even a nice clean one. And then put the rest of the money away for retirement, or his future. But, he intends to spend in approximation 50% of his "windfall" on a car (depreciating asset), and then the rest on rent for an apartment closer to campus so he can bang some tight college co-ed waffleswaffleswaffleswaffleswaffles. (Rent, another depreciating investment...)

I guess youth is really wasted on the young! But have fun and bust the shocker on a few beezies, and enjoy getting your car sideways and your dick wet.

    Ha. What Farbin said. ^

Glad to hear you got a reasonable settlement otter. You were acting reasonably and they were acting like they did nothing wrong. What happened to a company just admitting they screwed up and making it right? Could have saved them A LOT of money.

LS... you're the only reason I'm posting here. While I agree frivolous lawsuits are a scourge on our society, this is NOT one of those cases. The value of the car is just a small piece of this incident. Imagine that happening to your wife, kid, or parent? Would they have known what to do to avoid a serious incident? Maybe, maybe not. I want cases like this to force corporations into policy change and perhaps better hiring practices. And as a final note... no one is getting rich or hitting the lotto by reaching a $100,000 settlement. If that's your idea of rich... you don't know how to manage your money since you probably make decent money as an adjustor/investigator/etc.
