My car was worth about $2500 before the accident. I know that. And I'm not LOOKING to get anything. I offered to let these guys settle for $500 or $1000 when this whole thing started. I gave them a cheap and easy way out. No lawyer, no courts, no crazyness. Just cut me a check with a fair amount that will get my car fixed. I'm not claiming it was a near death experience. I've been shot, hit by a car, in a car going 150MPH when it wrecked, I've been stabbed and severely beaten. The offer came in 45 minutes ago. I'm not allowed to disclose the exact number for legal reasons, but lets just say that you're wrong, and I'm right. Even after my attorney takes his cut, I'm right.

Injuries and mental shit get that kind of money, but I wouldn't be surprised if your attorney is having you got the the chiropractor for "deep tissue damage" and the psychiatrist for "mental anguish".
I'm going to buy a car. Not a Ferrari, or an Aston Martin. I found an R32 GTR for $27K, and an NSX for $22K. Failing that, maybe a $15K Evo, or an E30 M3 would work. I'm not buying a house, but I'm going to treat myself to one of the nicer apartments up by campus. Its not a luxury pad or anything, but its nice enough and has a great view of the water. And I'm not buying, I'm renting. The rest will go to pay for school, and into my savings account. I think that's a pretty effective use of my windfall. I work hard, in school and at work. I run my own small business on the side. This might let me turn that into a full time gig because I can take the risk with this security net in my savings account.
My car is at a shop right now. If I drive it home and it catches on fire I'm going to expect compensation for the vehicles worth. Not because "I could have died". Not because the shop gave me a offer I didn't like or attempted not to take responsibility. I just love this AMERICAN concept where if someone acts unreasonable you act 100x more unreasonable to teach them a lesson. LolIn summary, fuck you. I gave them an easy and cheap way out. All I wanted was a couple of new body panels and some paint along with a handshake and an apology. They treated me like shit. The manager swore at me, and tried to blame me for what happened to my "piece of shit kraut mobile." He forced me to get a lawyer involved.

I had the EXACT same thing happen to me and I sued in small claims court for what I was out. I didn't attempt to hit the lotto. I investigate collisions and have been to civil depositions and I would be AMAZED if you got 100k. No idea why some one would be upset about the OP getting a full settlement. Big corporation does cheap dangerous labor, could have caused multiple fatalities, has to pay for mistake. Thats does not happen enough in this country.
Its not like the OP pretended to slip and fall in a restaurant and destroyed the owners life by taking him to court.
They made $1.48 billion in 2007. Ain't no small fish.

Do you really think that if Les Schwab has to pay out $500 for this that any real change to keep it from happening again is going to come forth? They tried to brush him off in the first place, did not take responsibility for their mistake, and could have fucking killed the OP and anyone else on the roads/in his car/pedestrians.
A $100 000 settlement is going to bring a change that could save someone's life. Maybe a mandatory documentation or check by a foreman/mid. manager of wheels being torqued, maybe a peer check over system, etc.
OP, if you're awarded this by the courts and do good things with it for your possible near death experience at no fault of your own, then good for you.Leave a comment:

I am NOT pushing for that outcome, but if that is what the offer ends up being, I'm not going to turn it down. Would you really stand on principle if offered that outcome and reject it?
I'll have a solid update later today, more than likely we're getting the first offer.
I got some nasty PM's about my "skyline and a house" comment, so I thought I'd clear things up a bit. I plan on buying a newish car, maybe an E30 maybe not, I have yet to decide. Nothing horribly expensive, but it would be nice to buy something decent that doesn't require a ton of work right off the bat. Plus, I like fast cars, so I'm not planning on buying an Accord. Then, I'm going to move into a slightly nicer apartment or condo that's closer to the university, and go back to school to finish my degree.
