    All the other kid did was race. And that is all that he should be charged with. He didn't force the other kid to do anything, nor did he directly cuase the crash beyond a reasonable doubt.

    Someone know the exact wording of washington's vehicular manslaughter law?

      It works like this - if you go with a buddy to hold up a liquor store, and he has a gun and you know it, and he shoots and kills the clerk - you get charged with murder - the crime was a foreseeable consequence of the activity in which you participated.

      Same thing here, the two kids race and a foreseeable consequence of it is a fatal wreck. But for the surviving driver, who would the dead kid have raced?
      Thus, without his racing, the wreck never occurs and the kid in the red car never gets french fried.

      He gets the manslaughter charge and not murder because it was obviously not intended.

            Wrong - you get charged with ACCESSORY to murder and accesory to armed robbery... not in any way the same charge... still 2 'fuck-you-very-much' felonies but not quite as bad...

            I think he does deserve the manslaughter charge though... like you said Dave... if he doesn't race the accident never happens...
