    False Speeding Ticket?

    Hopefully some of you can give me your opinion on something that happend a few days ago. I was driving to WSU to visit a friend. After getting on highway 26 to Colfax I hit the small town of Othello. Five minutes past the town I was on a flat road with no one around. A car passed maby every minute. I wont lie, Im sure I was speeding, but not excessively (speedlimit 60). Before I know it a cop in the oncoming lane slams on his brakes, turns around, and pulls me over. (FYI I have recently purchaced a Valentine 1 which has has never failed me. It has always alerted me WAY ahead of time) It read nothing at all the whole time before and during being pulled over. I get the stare from the officer for like 30 seconds. And am like
    "Hi?" He says to me "Did you know you were going 92 miles per hour?" I responded, "No, I dont believe I was going that fast." (I really dont think I was going that fast, I did not look at my speedometer though) He proceded to lecture me about how I shouldent trust that radar detector of mine expecially cause it was old and crappy (up to date with POP support) and that its not going to save me every time. He told me that he "saw me speeding from over a mile away and that he expected me to slow down but I didnt." I could hardly see a mile away anyway cause of the glare on the road. I couldent even tell he was a cop till he was right on top of me.

    In the end He let me off with an 86mph ticket. Im not going to complain too much, If I have to Ill defer it. Just dont want that on my record.

    So my question is do you guys think he made the ticket up or he valentine 1 malfunctioned? I know those things arent 100% reliable, but concidering the exelent results all around Ive had with it makes me wonder otherwise. I forgot to mention that on the way home, I was going through this town and was radared on K band 4 times by officers in the oncoming lane. Two of those times they only targeted my car. Im assuming the cruisers would be equipt with the same equiptment? A friend over at WSU told me she recieved a BS ticket near there which makes me wonder. Im sure traffic tickets supply a large amount of income to these small towns in the middle of nowhere. Let me know what you think.

    yea... why didnt you ask him to look at his laser readout?

      yea you can ask to see the readout. I would be scared to start being a prick because he could start finding lots of things wrong with my car. Cops are just dicks. I bet he made it up.

          I think whether or not he made it up or if you saw a readout, i'm sure he could falsify a readout later.

          Can you fight it and get it knocked down a few $?

            Unfortunately I didnt know about the readout at the time. I called crivellone and asked him and was like DAMNIT! But whats the use. The last thing I needed was him to search my car or make up some bs. Im thinking he made it up after he could tell I was prolly speeding. Oh well, shit happens. Im headin off to vacation and college so Im not going to have time to fight it in person atleast. I will prolly get a lawyer in the area and have him go out there for me.

            Someone mentioned to me about checking the last calibration of the radar gun / checking the last time the road was evaluated for the speed limit? Can anyone tell me more about checking that out?

            btw, is it illegal to drive without shoes? Cause im sure a hell of a lot safer barefoot than in flip flops and he didnt tag me on that.

              a deferral will keep it off your record. it just sucks, because you still have to pay the ticket... and you only get one deferral every 7 years. do you have x band detection turned on?

                Yeah, I got X on. K, KA, X, Laser, and POP support, the full deal. Ill prolly go with the deferal if a lawyer cant get me off. We have had pretty good luck with the lawyers in the past though, hell they are cheeper than the ticket!

                    I wouldn't be surprised if the cop made up the number. I've been pulled over numerous times for no reason and have called the officers on it. They usually bullshit something about how my inspection sticker looked like it was falling off... Gotta love the small towns, eh?

                      I don't know Tacoma, but in NY >25mph over is bad. Here you can get a lawyer and beat it down to a 1201a, that's parking on the sidewalk or something. Cost $250, pay the lawyer and no points on your license. It's a business, everybody makes money, everybody's happy.

                      My kid beat a ticket because he knew all the cops and the system. The same thing happend to him. Cop was pissed about the Detector.
                      Cops have to get their eyeballs calibrated, OK recertification every 6 months in order to write a visual ticket. If that isn't up to date, the ticket is invalid.

                      Get a lawyer.

                        You admit you were speeding. You don't think 80+ in a 60 is excessive. You can't tell if you were going 70 or 92? Sounds to me you probably got what you deserved, radar detector or not.
                        Yes, small town cops often do speed enforcement for revenue generation. Sometimes they fib a little. Regardless, reading your description of the events I think you are guilty as charged.

                        And yes, I have a nice collection of speeding tickets myself, so I am not a holier-than-thou, law abiding, traffic impeding goody two shoes.

                            Law Enforcement departments are getting wise to the radar calibration defense. If you search the subject you will find that most departments will send 1 radar gun off for certification every 6 months and all officers will use that cert paper in court regardless of the gun used.

                            The only way to get a sure answer about the radar calibration is to get the officer to provide you with a print out from his gun or have him document the serial # of his gun on the ticket. This way if you decide to go this route then you can request the calibration records for that particular gun BEFORE court so you will know if the defense is even worth the effort. They are considered public record so whichever dept. the officer works for should have them on file. You may have to pay like a $5 or $10 for the record and if they refuse to give it to you just ask to sopena the records in court and make sure the judge knows that the dept. refused to provide these public documents to you beforehand. At this point if you are 99% sure the gun was not calirated within the requirements of state & fed. law then you can get out of it.

                            If the officer refuses to provide you with the radar gun readout or serial # request that he add that to the notes on the ticket.

                            This method works if the ticket was issued by a city or county officer but not with state troopers. They usually calibrate their equipment more often than required.

                              pay the damn ticket and move on. be responsible for your actions. i speed all the time. if i get caught i deserve the ticket. its a matter of odds
