    Mein Auto ist Kaput. Hoffentlich nicht für alle Tage...

    Yeah, so, last week a 2.5 ton Ford E350 plowed into the back of my pristine E30, thus totaling it.

    The insurance company of the fat heifer who hit me is only going to give me 2400 USD for it because of the milage on the odometer and the year of the car (an '88 with '89 bumpers). However, the engine only has 48k on it, as does all of the drivetrain, suspension, paint, interior--EVERYTHING. This car was spotless and perfect. Now it is ruined.

    I figured I'd ask the E30 community for advise, seeing as how some of you have probably dealt with this problem before.

    Is there anything I can do? We do not want to still pay for this car after only recieving 2400 for it, and then they take the car, and then we have an extra grand to pay off. It just isn't fair.

    I have been told I could call my insurance company and see if they can help me out with this. However, then my insurance would go up (it would be worth it) and I don't know if my parents would fly with that. [I am a college student and y'know... my parents help me out a bit.]

    P.S. I will have pictures soon if anybody wants to see the damage. The trunk is busted in, it needs a new rear bumper and shock, the rear quarter panel is kinda munched in a bit, and I do believe it bent the right rear suspension/frame (PLEASE GOD NO), thus making the right rear tire a little crooked. All E30s have the camber in the rear that makes the top of the tires point into the car a bit... Well, my right rear sits exactly straight up and down now. It is noticeable. Yes I took a picture.

    They have to, by law, find 20 examples within 300 miles of equal condition to asses the value of your car. In my car [3 yards ago, 91 318is with 118k] they only found 2. I sat on it for a year and got 3900 instead of 2700. And that car had horrid paint, but was otherwise nice. Argue your point, provide them with for sale ads of cars you think are as nice as your own, or make them find you a new car. Sorry to hear about your misfortunes, and arguing the with insurance company will make you want to off yourself pretty quick. Good luck!

      I'd tell them their insured without precaution rearended me thus causing my beloved vehicle to be destroyed and that I had terrible headaches, neck pain and back pain (medically very difficult to disprove conditions).

      I suggest offering them a reasonable amount to settle for and tell them in the case they do not accept the offer that they will have to pay for years of chiropractic as well as therapy which will total far more than I was asking for now. (as well as your lawyers 33-40%).

        That sucks man. Sorry to hear that. Some good news though. My friends sister got rear ended in their 95 Mitsubishi Diamante black on black leather in mint condition (rare color combo). The car was totaled and the insurance wanted to give them $2500 for the car. They fought it and a few weeks later (not months) got to eaither take $4500 for the car or, $3500 and keep the car. They kept the car, got a new rear bumper put on and it is as good as new.

            I had 4500 in recent repairs, and everything was mechanically perfect on my car. Their insurance company found some bogus comps and offered me 2500. Their comps were months old and there were no photos or descriptions for the cars. I called them on it, then found some clean comparable cars here on r3v for 4700, 8000, and 10,000, and sent them to the insurance company. After much debate we settled on me keeping the car and they sent me $8500 for damages and $690 for lost use (rental car).

            DO NOT settle for 2500. Find out what they used for comps, and then explain why your car is significantly different than a $2500 beater. Find your own comps that are ACTUALLY comparable and submit them to the insurance company, along with freight quotes to get each car shipped to you.

            ALSO, get checked out by a doctor immediately. Even if you feel fine. Their insurance company is required to pick up the charges so don't worry about that.
