Ebay Trouble??

No I didn't get it in writing, but he really has very little ground to walk on because he was "told" it was bent and he still put a tire on it. I might be able to do something for him if he didn't mount the tire but he did so I told him the situation was over.

Any time you sell somethiong on ebay you should document with pictures the condition of the item. You also have the tire shops balancing of the wheel....did you get that in writing??

So I think the situation is over. I told him that USPS said that since he mounted the tire the insurance was void. I also told him I couldn't do anything about what happened cause I sent him a good wheel and he has been driving on it for I dont' know how many miles.

One thing he is still trying to pull me with is that he waiting so long to get the wheel. I simply told him that the week and a half that he waiting is not very long..atleast I wouldn't say it is that long to wait for a product.

Sorry its been a while. This is what my situation. I sent you a rim that has been checked by 2 people and by myself and it measured fine. I definately would have saw the bends in the rim, since they were so severe in the picture. I have on my Ebay ad that there are no returns which I might have worked out but you were told, by the worker at the tire place, it was bent and you still mounted a tire. I can't tell what happened between the time you got it, turned it, put a tire on it, drove home on it. That could have been many miles and a bent rim can happen any time any place. This rim was near perfect and definately didn't have those bends in it when I sent.


If you wouldn't have mounted a tire, I could have tried to pursued something more with the post office but they said that it would have been the way it was delivered to your door hence not with a tire mounted. I am sorry about this but I can't do anything for you. I want to keep my customers happy but this I really can't do anything about.

Funny that I might be having some "Ebay trouble" of my own.

Sold a used distributor off of an '87 Saab 900 Turbo recently. Shipped it out like 2+ weeks ago, then today I get this email from the buyer:

"Before I proceed with negative feedback and a claim against you, want to give
you a chance to explain how a distributor with less than 10K miles on it would
look like this one. Care to respond?"


My first thought is to tell him to go f*ck himself and lose the attitude. I've been buying and selling on Ebay for a while, and I ALWAYS give people the benefit of the doubt- up to a point. So, I thought about it for a while, then replied to him that, yes the distributor did have less than 10k miles on it, though the car had been sitting for approx 2 years because of a dead clutch. Not sure why he thinks the distributor has more than 10k on it- it really is in great shape. I put the ball back in his court and asked what he would like me to do to resolve this.


We'll see what he says.

The "government agency that handles internet fraud" I'm SURE will be all over an $80 dispute over a bent/not bent wheel.

A tire shop will mount a tire on anything that a customer asks them to- they don't give a shit. And, it's not like they'd be able to tell that the wheel/tire will balance out until the wheel has a tire mounted on it. Some wheels that look bent to shit are perfectly fine once you get a tire on them- and some that look perfectly true are impossible to balance.

Mastrcruse mentioned that the wheel did have 1 bend in it that he knew of- so it's feasible that there could have been another one that he simply didn't notice.

Actually used the agency twice. Once for $60, once for $325. Got my money back both times - only took 3 weeks or so both times. So yeahhhhh, pretty ineffective. I can give you a link too if you like.

BS on the tire shop thing, at least around here. Goodyear won't mount unless you sign a waiver. And bent is bent, if it looks like it it is.

You might be able to bend a wheel mounting a tire, but you would really have to try.

If you measured the rim, and it was straight then leave it at that. Tell him straight up that you believe he's being fraudulent, and if he wants to persue you in court, he can. But his arguement sounds like weak sauce, and wheels get bent all the time. Whoever said he bought your wheel to replace the one he bent is more than likely right. If you stated "as is" in your auction - then remind him of that too.

If the guy is here on r3v - call him out. Get it on!

If you claim shipping damage against UPS, you better have some good proof of the wheel's condition when you shipped it- and you better hope that it was packed well enough to suit UPS- they usually just claim "insufficient packaging" and deny the claim and there's not a damn thing you can do about it. They are the only ones who know what "sufficient" packaging is and they like to change the definition to suit their needs.

I made my recommendation several posts ago. YOU decide what you think is the right thing to do and do it. Continuing to post here about it will only confuse the issue and give you lots of great ideas for things to do that these guys don't have the balls to do. Give the buyer the benefit of the doubt, put yourself in his position and "do unto others...."

That was my thought. Why if it was so terribly bent, you would put a tire on it? That doesn't make any sense. Can rims get bent in getting tires mounted? He came right out and asked me if I wanted the number for the shop. One thing I dont' like is it is bent he still put a tire on it. I dont' have returns and don't have insurance through paypal for my items. Its buying at your own risk and all of my buyers have been happy with what they have received. I could call but what tells me that he doesn't have a buddy working at this shop.

You can't retract feedback, and ebay won't delete it either.

Tell the guy politely that you know the wheel you sent was true, and that you don't appreciate his attempt to defraud you and steal his money back. Tell him that what he's doing is considered fraud, and that you will pursue this in court if he would like. He'll more than likely lay off.

Burdon of proof is on him to prove the wheel you sold him was defective pre-mounting - ask for the phone number of the shop he used, a faxed copy of the mounting receipt, and the manager of the tire stores' name. I highly doubt a tire shop would be willing to mount a tire on an overly bent wheel, and if it's not noted on the receipt he has, then tell him you won't accept his claim of a bent wheel, nor will you help him claim insurance money on the shipping carrier.

Here are his. If you are looking at my pic, I do think the pic makes it look like hit has a slight bend in the lower right corner but I can promise/swear to you that it is not a bend, it is the camera and the pictures that I attached are the ones that he sent me. Look at their positions and a camera could not hide those.

Do you have any pictures that would clearly identify your exact wheel, like a spot of curb rash, or chipped/scratched paint? If you do and his pic of the wheel in question doesn't match, tell him you will take it up with ebay.

I'd get directly in touch with Ebay and tell them what you suspect before he has a chance to file negative feedback.

And yes, sounds like he's trying to screw you. Let him know that after you file with paypal, and let him know that fraud on the internet is a crime, and that if it goes far enough there is a government agency that deals with it.

I do have the pics of what I sent him. They aren't the best but I am sure that one mark on his picture was not on my wheel, its like a honeycomb shape.

He already gave me a Positive feedback telling me he loves the wheel and it is in great shape but in the pictures he sent me you could obviously see the bend now after 2 weeks though it is "bendS".

Can he retract the positive feedback and change it? Also I have made 12 transaction...maybe 4-5 as the seller and have very good, all positive feedback.

It is praacticly impossible to bend a wheel that bad in shipping. I think the wheel you sent was fine and he prob hit a pot hole with it or something. If you sent a strait wheel, and it is now bent so bad that it can't be used, he fucked it up and is trying to fuck you over. End of story. How much did you sell it for?, if you don't mind.

I sold it for $80 shipped. I have a weird feeling that he is trying to pull this,
The seller (me) will give me my money back, I (him) won't send the wheel back. He gets his $80 back, He gets the wheel and sells to a junkyard and makes $40 off the transaction.
