    Ebay Question

    i bought an OEM E36 Radio of an un named seller on ebay, the auction clearly states that the radio is in good working condition, which was fine with me, i won the auction paid shortly afterwards with my visa, and all was well, i wasn't happy with the amount i was charged for shipping, 30 dollars from NC to NS but i wanted the radio so not the end of the world. anyways, the radio arrives, no code, no i'm not sure, but in order for a radio to be in good working order, you kind of need the code. so i contact seller, it's out of a car he parted a long time ago, doesn't have the code, so i figured hey, maybe he forgot about it. no biggie, i just told him that if i couldn't get the code from the stealership on tuesday, i'd expect my money back, and he could have the radio back. he said no his auction clearly states no returns...

    do i have a leg to stand on, or does he have me by the balls.

    I would think that your screwed on this one because it says no returnes. Did it say that it came with the code? If it did say that then you should be able to send it back. If not I am not so sure as to what you can do.

      Have you installed it or anything? This is a big no no. I am going through a situation with a guy that I sold a perfect wheel too. He said the shop told him it was bent but he still mounted a tire on it....fishy. Don't install it but I do believe the dealer can get you the code.

        The dealer can get you a code in about 2 seconds. The radio probably does work perfectly. You should have clarified with him earlier about this type of stuff.

          The dealer won't give you the code. They will have to see a registration from the vehicle in order for them to give you the code. I tried this for rigmaster at the dealer I worked for and they would not give it to me.

            I beg to differ. Ive had to get the code for 4 different e30 radios and theyve never given me a problem. If they do give you crap about it just make sure you print off your paypal receipt or the ebay auction confirmation or whatever have you to prove you bought the radio.

            I can see how theyd give you crap though man if you just showed up and was like hey I have this radio.... Seriously though, these decks are ten years old, noones going to try and steal em anymore.

              If in the auction he said it works, that means the radio will work when you get it. It doesnt, therefore he lied to you and he is obligated to give you your money back, regardless if he said no returns. if he wont give you your money, he can lose his account.

                Powering up and saying CODE is not working perfectly. Tell him you will file a claim with Paypal & eBay if he does not give you the code, pay the dealer for the code or refund your money plus shipping in one direction (fair for him to share 1/2 of the shipping cost)

                  Paypal won't do dick for you, unless you can prove that you paid for an item and never received it. IF you decide to file a claim of any sort- your best bet is to file a dispute through your credit card. Most credit cards usually take the side of the buyer and leave it up to the seller to prove to them that the charges are valid. You will have to send them a statement of your side of the transaction, but they should be able to help you out.

                  The dealer should give you the code free of charge, you will have to provide proof of ownership of a BMW- it doesn't really matter what the radio came from- and the serial number off of the radio- it'll be on a metal plate or a sticker. I agree that it's ridiculous that BMW is so strict in their procedure for giving out codes- as no one is going to be stealing these POS OEM radios - but it's their policy and you have to work with that.

                  Before you get your panties in a wad, see if you can get the code and see if the radio is in perfect working order. If it's not, THEN you need to make a stink with the seller.

                  BTW, feel free to post up the seller's info or PM me with it- I live in NC and if I know the guy I'll see what I can do to get him to own up for you......

                    The threat of filing sometimes is enough to get sellers to wake up.

                    Be aware if you file through your cc & get the money back Paypal will suspend you pending giving them back the money. I am speaking from experience here.

                      Take heed to this warning. I've had many friends go through this. I've been victim to this as well. Since Paypal isn't a bank, they're not obligated to follow federal laws, like banks are. Such as giving ur money back, n' shit. I think this is what my friend told me. Of course they'll get your money back to you, eventually though.

                      So just becareful. Paypal can screw you royally.

                        I got a radio code after calling numberous dealerships, a pain in the ass, but i did get the radio for a great deal because it didn't have it.

                          Correct.

                          But at the same time, I've had the stealer give me a code for more than one radio without any questions. As long as you know someone there who can vouch for your credibility (or have a receipt to show) then you're set.

                            Why not just install it in the car and then go to the dealer and tell them you lost the code. Then they will give it to you with no hassle.
