      thats actually not that bad really, but probably some suspension damage in there. Still.....sad seeing that car getting hit. One night we put new suspension in it, the next night its gone.

        Did the cop give her a breathalyser? I know if I hit someone with alcohol on my breath it would be "why don't you put your hands on the hood of the car for me"

            I'm really sorry to hear about your car man. Last week some chick almost rearended me at a red traffic light, and it really got me thinking. I know the KBB of my car is $3600 and with a value like that, it would be really easy to get totaled. Funny thing is i paid, $4000 for the car in dec and since then have probably dumped close to an additional 4 grand, and i'm still not done. I feel for you dude, and i hope everything works out.

              EXACTLY! No if's and's but's about it! I don't wish jail upon her or whatever considering nobody really got hurt and insurance is "taking care" of the situation but, I have to imagine had it been a guy, his ass would possibly still be trying to bond out.

              I know exactly what you mean as I was just down in the garage with the appraiser. I offered him a beer and some money but he said no. j/k But we discussed quite a bit and it seems I'm going to get screwed. I was playing around with the numbers in my head as well and know all I can hope for is to get as minimally screwed as possible. My seats had been reupholstered but had two minor tears on them but due to the wording/grouping in their rip-off sofware, I have moderate wear. WTF!? I won't even go into all the other BS.

              BTW, they totalled it... Awaiting the settlement amount now.

                  The only thing I can think of is that you made a lane change within an intersection, even though it was to take evasive action.

                  Did they give her a breathylizer?

                  If her insurance co. is going to screw you, I would start complaining about back and neck pain.

                    That's something completely different. I should have just stayed in the lane nearest her so she could have hit me more in the center of the car maybe then causing me to roll over as opposed to spinning around.

                      hahah... right after my post i called my insurance company, and apparently i can prorate how much my car is worth. Hahah... and get this, i can do this up to $150K if i dont mind paying the premium.

                      Anyway, what i have never understood is how the "other guy's" insurance can total a car. I mean if their client was at fault they should pay you how much it costs to fix your car, not the KBB value on it. That just makes no sense to me.

                        I believe you can challenge the findings on the accident report as well.

                        Either way, I would see a doctor about the "pain" I've been having since the accident.

                        If they are going to try to screw you, then they get what they deserve.

                          There's no question about fault. That's not an issue. (I'm driving down the street minding my business and some dumb waffleswaffleswaffleswaffles bitch, buzzing on her apple martinis, drives into the side of my car.) I've already got a rental and the appraiser has come by. The screwing may come when they share what they consider the value/settlement of the car. An attorney is pending this information...

                            Damn. My E30 was totaled 2 weeks ago by a woman running a stop sign. I feel for you, my deepest sympathies.

                              Ins says $4,450 (plus TTL if I don't buy it back... ) however I am really tempted to buy it back as there are alot of good parts on it. They want $500 for it and I don't get TTL in that case, of course...

                                so, the final verdict... from $4,500 I got the settlement up to $5,850 (with some repair/work invoices I sent them) bought the car back at $490 and have someone ready to buy it at $1,300. So I'm pretty much getting $6,600 for this whole bullshit ordeal. Needless to say, I still would rather it not have happened. At least I'm not really getting screwed.

                                I was able to push/snap the lose rear right bumper piece back in and pull some of the wreck out using the e30 jack (McGuyver style). Just enough to keep the fender from scraping on the tire. Drove the car around today and it's good although an alignment is most definitely in order. Not bad for a total but I guess it doesn't take much for an e30 to be... Add that some of us put alot of money and time into them and it really sucks.

                                Get this, at least in the state of Texas, if an insurance company totals your car, they are not required to provide you a rental. However most will just for a few days but not even necessarily up until the point of you receiving the settlement! Some Texas laws are way out of wack!
