Sounds like a bad April Fools joke.

And if the attorney you spoke with said theres nothing you can do about it, then he wasn't a good attorney.

The tow bill becomes another lien, the tow company is the lien-holder, viola!, it's their car.
If the bank decided to write off their note because it wasn't worth the storage/tow fees, they simply don't claim an interest in the vehicle when presented with the option.
        thats exactly right

Is she hot and if so, any pics?

Seriously though, I would consult with an attorney.

One more thing - the Consumer Advocates on your local TV news channels LOVE stories like this and might get interested if you contact them as well.

if the car had current tabls/license/registration, you definitely have grounds to sue. I believe they can declare a car abandoned if it's left sitting with expired tabs - but if they were current, I'd report the car stolen.

I don't know who I should peruse as being at fault though.

Sounds like the tow company is at fault to me. At the University I went to, certain lots couldn't be parked in after the semester was over, during events, overnights, etc. So if she was possibly in one of those lots, the school had a right to tow. Shitty of them not to notify, but seems like her addresses might be all out of date anyway so it would have done no good.

However, if the car had plates and registration, obviously it's NOT abandoned and they should not have crushed the car, certainly not when the ownership/status was in question.

                  I would go after them.

the university started this, and took action. they called in a toe for a vehicle with current tags, and a current parking pass. they're liable for not contacting whoever the parking pass is registered to.

Personally, I would pursue each individual entity, and blame them, one case will win, or split liability, and they both pay portions.

Not necessarily. It sounds as if she may have left it there for a long while, maybe with tickets, etc. Like I said, just because you have current tags, doesn't mean you can permanently park it. If the school DID have it towed, I really think she was in a no-park after a certain date/time lot.

Of course, it's speculation, but it seems silly that the school would just randomly tow a vehicle unless there was a reason for it.

I would start with them and find out why/exactly when it was towed.

Look at it this way. She most likely paid for the permit to park on campus. If permits are given for free to students who submit the appropriate forms, then she paid for it with tuition. Bottom line, they granted her the ability to park on their property and for an exchange of a fee. Although they are not responsible for her car, they dont have the right to do what they want with it since they are providing her with a service. UNLESS, they can prove that they made several efforts on contacting the person on file under the parking pass number.
