if you are doing something like the OP is and just DUCTING the air to your cone filter hanging inside a heat shield, it is pretty unlikely that you will suck up water. you are just trying to force as much air (colder then engine compartment air) to the filter as possible
if you have the cone filter mounted down low where it can get into the water, yes you can suck in water. we used to call them straws.
