Scammed on eBay for a Nextel i730

Guy said it was perfect, in a cool blue case, & included the perfect original case & came with all accessories. I got a thrashed phone with no display & nothing but the battery, belt clip & battery door. The case is totally thrashed!

I returned it to him (in FedEx's hands as we speak), & emailed him. He says I broke it, & stole everything that is not there!

Paypal says if I got a package I am done! eBay will do nothing. I was hoping one of you guys in Seattle might be willing to let him know internet sacmmers suck! (and find out what the local laws there are regarding internet fraud).

Here is the auction, I should have known since he said his camera was broken, and I had to practically interrogate him in about 5 emails to ask the condition, items included etc. I have all teh emails that are lies. Should have known better.

Did you use Paypal through your bank account or through a credit card.

You can cancel the credit card charge and then paypal is fucked to get thier money out of him, if you used your bank you are most likely screwed.

I used the bank because I waited a week for the money I transferred to paypal, in order to use my paypal CC. still wasn't there & he was giving me a hard time because the auction ended Saturday & the money cleared Tuesday. I am screwed unless I can get a local person to (1) help me out & call him & let him know this bs of saying I am trlying to steal a sim, charger & original case is rediculous. and (2) please find out local statutes regarding this type of crime.

I have over 300 eBay transactions he has 10 why would I choose this one to be an ass? He says I broke the display, I say more likely he did when he swapped the case, the ribbon taht connects it is notoriously fragile.He said the case was perfect it's thrashed likle a cheap case would be after a years use, not in a way it could be from me being a jerk & abusing it.

Well, out of over 1000 transactions I have had 3 actual problems. I submit it would be the same (if not more) in a brick & mortar world not to mention the nature of my business would be virtually impossible to conduct without the web.
