^ disagree, a while ago i struck an illegally parked car because i couldn't see it (sunrise, super low angle sun right in my face, driving through a parking lot.) sure, it could be argued i was negligent because i was driving when i could barely see, but the cop cited the other guy as the faulty party because he was parked illegally in a fire lane. he was also facing into opposing traffic, in what was essentially the road, in front of the shopping center. the officer, a friend of mine, stated that i had the reasonable expectation that nobody would be parked there, and i was driving as carefully as conditions allowed, hence i was not at fault.

from the insurance end, they paid to fix the other dudes car, and raised my rates. i argued that they should not have paid out for a not at fault accident on my part, but they refused to change the decision. so i swapped to another company with a better rate. makes no sense to me, insurance had (chose) to pay out for something they should not have, imo. /coolstorybro

Making a left turn at a light, looked at the guy coming at me thought I had plenty of time, guess not. He slammed on his brakes and slide into me. We were both talking about it he was very apologetic about it and said I'm glad your not pissed off. We both thought it was his fault. This is where it gets weird.

Cop shows up, makes me at fault, because he had the right away. One he must have been flying, two he went through the yellow after me might even been red, and HE HIT ME!!!!! I really don't get it. Trying to fight it, hopefully works out for me.

Oh yeah, cop talked to me after he talked to the other guy, said now look here Im not gonna cite you for your moving violations, which would be a fine and three points, but I'll drop that and just fine you for your tinted license plate cover. I guess thats a good thing but I really can't stand cops. Three of my friends and I have been arrested for a crime we didnt ever commit but thats a whole different story.

Lets just say I am less than pleased with all the experiences Ive had with cops over the past two years.

Anyway, I will most definatly be sourcing my own parts. and of course pbs are coming, and of course this happens after I just ordered a brake kit, muffler, wheel bearings, short shift kit, and a whole bunch of little maintance stuff. Hopefully I can finally catch break.

Who's assuming now? I don't need to be there when you already give all the info we need.

EDIT: You obviously need more time on the road and need to work for an insurance company.

Whos at fault is not the officers decision, but the insurance. At least thats how it works here. In an accident like that they can easily split it 50/50.

Same exact situation happened to me. I was making a left on a yellow and I thought I had plenty of time, I got hit, by a yellow honda accord. I ended up being at fault even tho he ran the yellow and must have been going 40 MPh thru the intersection . hit me in my passenger rear wheel. I fought it for the longest time, and was even declared not at fault at first. But apparently I was. You have to yeild to traffic while turning.

lol so your fault. If his light was red, your light was red. You shouldn't have been going. Regardless of speed (you can't prove that anyway), you crossed the lane he had control of (known as "right of way"). Unless he was obviously yielding his "right of way" to you, you have no right to enter/pass his lane.

Speed has nothing to do with it because you entered his lane. A stop light has nothing to do with it or else you are both at fault. In which case, you are more at fault than him and he gets off.

You can't prove he was speeding
You can't prove he went through a red light

Definitely your fault. I got hit making a left turn as well at night when a Hyundai Tiburon came flying with only his amber's on. Still my fault, you learned the hard way as well. I never made the same mistake again. Learn from your mistake and stop looking for excuses.
