        Give me till tomorrow I will see if I can get the full story on this one. I know the lead environmental inspector, On that spread of that work and have a couple other buddies that are up there on that job.


        Ok before I hear back I can say with some assurances I know just what is happening here. This is my industry and this happens on most all jobs one nut case.

        Ok Enbridge has a existing ROW (Right Of Way) where there is and existing pipe line. Enbridge is laying a new 36" Oil line through there on THEIR Existing ROW lease, that means they can PUT NEW infrastructure maintain and do what ever they need to on that ROW. Now I would wager the existing ROW is 50' wide and normally when they are adding a line in or building a new line they have a temp ROW for work space of 100' wide. Since they are being whiney bitches about not taking the money for the damages on the extra 50' of temp ROW for the construction Enbridge has said fuck you we dont need to have that much space for that little stretch and continued on with their project inside the limits of their existing ROW WHICH IS THEIR RIGHT to do.

        As far as arrested for trespass, That land is leased to the Gas company an is all in the terms of the existing ROW agreement from when ever the original line was laid. Which allows the Land owner to use the land for anything but building on or things that may inpeed Pipe line safety or operation. Now the fact remains that it is leased to the Gas company (read gas company property) and if you come out there and have been making trouble the contractor and the gas company have the rights to arrest you.

        That said these people were holding out for more money on the temp lease or were not the original land owners and didn't get shit for the original lease and are mad that they are bound by it.

        Edit: The gas company's have to pay the property taxes on all of their ROW's so yeah they have the rights to dig on it all they want, its a courtesy to the land owner to pay them when they build a new line on that ROW for extra ROW and damages for crops and what not.

        there is one nut case on every job, I know a few guys that got shot at by a crazy old man in NY last year cuz he found out his neighbors got more money for their ROW lease than he did and tried to run the work crews off

          technicly, the conctruction company is tresspassing if hey have no written permission, or a legal right to the land (atleast thats how it is in NC)

          its total bs in my opinion. if it would have been my land, i would make a trip down to that area at night and drain all the oil out of the equipment and make it un-noticable. then tell them to go EAMFD.

            Yep, big gas companies here are just going where ever they want. They think everyone wants their money. I know several people that have thousands of acres that flat out told the gas companies to go around. Oh, and the have the money and lawyers to put EAD in writing.

              DID YOU NOT READ????? DO you not know what a ROW is. There is a existing agreement on that section of land that is LEASED to the gas company. The contractor only need Enbridges permission to be on that land. The gas company lets the land owners use it for what ever they want with in the terms of that lease agreement.

              And if you were to do that you will spend time in jail for destruction of property and have to pay the damages to repair all the millions of dollars of iron you fucked up. Pipe line contractors have way more money than you and the gas companies have way better lawyers and way more money than you do as well

              Resto: Thats fine they can tell them to go around, as there is no existing ROW agreement for that land. But in many cases if its 1 or 2 fuck heads holding up a 500 million - 8 billion dollar plus project it will just get condemned and taken

                    mrsleeve... that's a good analysis but I read that another aspect is that Enbridge is changing the nature of the ROW which never allowed petroleum products. I've seen some of the explosions from older natural gas lines and that would worry me on my property, too.

                      Yeah you are correct this is one of the reasons they are putting a new line in!!! the old one is way past its service life (the old ones were designed to last about 30 years) I would be very scared of the old shit. I have been on lots of dig ups and repairs its scary.


                      Thats why the pipe line industry is so fucking busy right now, replacing all that shit put in in the 40' 50' 60's and upgrading capacity for the future. They had a products line in there (refined shit like gas, diesel, jet a, etc...) this is a new crude line IIRC, with a parallel line for shipping a low friction shipping agent back to the origination point to be added to the oil to help it flow through the line.
