Father 'throws baby daughter into path of moving car'



A father is being held by police after allegedly throwing his baby daughter into the path of a moving car.
John Taylor is accused of tossing 18-month-old Jayla into oncoming traffic in Oakland, California.
She narrowly cheated death and escaped with cuts and burns after scraping the undercarriage of a Volkswagen Jetta on Sunday evening.



An off-duty policeman said he saw Taylor, 21, who is separated from the child’s mother and was looking after Jayla for a day, shake the girl by the roadside.
He then allegedly threw the toddler into the traffic and then ran off, punching and kicking stopped cars as he fled, while a neighbour rescued the baby.
Drivers tried to stop Taylor as he ran from police and, when officers caught up with him, they found him in a violent scuffle with motorists.
He is then said to have brawled with police who eventually shot him with a Taser and arrested him on suspicion of willful cruelty to a child, vandalism, resisting arrest and battery on an officer.
Miss Bartholemew, however, says she doesn't believe the story and says her former partner was under attack and did what he could to protect their baby.
‘I'm hurting now because I know my baby's father is in jail facing charges and I don't feel that it is reasonable,’ she told NBC News.
‘Anybody who feels that they think that John had thrown the baby out, please get that out your mind - there is no reason to believe that. He is a great father to her.’

I love the girl's mother at the end, defending her baby daddy to the end.

1. Oscar's priors have nothing to do with this case.
2. BART officers recovered two weapons an hour prior to this incedent, putting them on edge.
3. oscar ran in and out of the train before being detained, who is to say what intent he had by doing so.
4. While being handcuffed he started to struggle forcing police to take further action.
I believe the officer went for their tazer and made a mistake which is inexcusable, but no 1st degree murder can be sought.
This whole case is retarted. Shame on the DA for trying to get him for murder. Murder is only triable when intent is clear. There was no intent to kill in this situation. The DA (instead of being responsible to their community) seeks murder due to public outcry instead of explaining why they need to try for involuntary manslaughter. If you even try for first degree, you run the risk of an aquital, then he walks. Sentncing hasn't even happened and people are rioting? They need to do their researc before reacting to the verdict. It pays to have a Lawyer woho works for a DA in the house when trying to sort through the Wiki article.
