In theory youre right. Or they could do what they usually do and make shit really difficult for you until you consent. They have ways around irritating things like civil rights, and ammendments.....

(my car always smells like weed when I get pulled over) and every single fucking time they tell me "alright that's fine, but if you decline you're going to have to come down to the police station after we have your car towed there, then we'll get a warrant and search it."

Either way, if they want to look, they are going to.

Regardless of whether or not I risk getting searched. I'm definitely planning on spending a Sunday pulling the seats out and cleaning under the carpet. At least for sanitary purposes, and to get rid of any hazardous broken glass and mold.

And who knows, maybe when I do a thourough sub-carpet cleaning, I'll find what I was looking around for in the first place....CASH

Call them on it. If it's a simple traffic stop they have no grounds to arrest you or tow your vehicle.

Unfortunately it's the nature of the business, and somewhat unavoidable. I don't have a problem with them poking around, I have more than enough documentation on me at all times regarding medical marijuana, and I never drive under the influence, so it's really just a hassle more than anything.

On paper, your argument is sound. But you have to remember it's entirely up to the officers discretion. If he says he "smells" anything or sees any paraphernalia, there's his reasonable doubt. And that goes for anything, not just marijuana. I've had the hood popped on my GTO 10+ times looking for shit, just because of the way it sounds.

cousin works for the local PD, he told me the weight and got ride of it for me, i didn't want that shit around me at all. it isn't something i want in my home with kids, dogs, etc around.
