Exactly. Even if it did come out of a machine on site (or wherever the salads were packaged), what would he be recovering for? I see no damages. Putting in a claim against either McDonalds or the franchisee's insurance company (depending on where liability falls) would require a submission of medical records/bills or some proof that you were either bodily or financially impaired by the rod that you found and didn't eat - and that's putting aside the fact that you'd have to reasonably prove you found the rod in there at all after the fact.

I think Janderson, is pretty spot on this one.
There's no way to prove that it (metal rod) wasn't planted in there once it left the restaurant. I will advise for you ask to speak to the owner of that particular McDonalds franchise., the management is usually pretty stupid and won't know how to react.

You might get free meals for life on this one, but I highly doubt that you will get a free ride to wealth & retirement.

To an extent this is true..... I think when people sue and fail to calculate personal accountability into the equation (which happens in the majority of the cases), its wrong. In this case, he had no fault in the matter BUT I think the rush to "sue" is wrong as a human being. But I am conflicted because I know every other human in this world, including the huge corporations that one is a patron of, will fuck you any chance he/she/they get. But thats what differentiates a better person from the painfully mediocre masses. Its a moral dilemma, if you will. Its so tempting to do what people are suggesting in this thread, as impossible to prove as it is. Because best believe they will have top-notch paid lawyers. The sad part of this is, that whether the person is in the right or wrong, we all lose on both ends when we become a litigation-society. Freedom of choice becomes narrower and narrower because there was 1 idiot in 300 million that didnt know coffee was served hot (thats an example to prove a point, I am in no way suggesting you are one of these idiots, this was out of your control completely.)

Even if you could prove it was in there, you wouldn't be getting much considering she didn't sustain an injury from it being in her mouth (ba dum BUM).
How about you just do the right thing and contact the McDicks you got it from and let them know so they can make sure it doesn't happen to anyone else and end up worse for that person?
