Sold a lady a car, now husband is trying to get money back. Suggestions?

      No one, I just know the guy and he has fucked over so many people by selling cars with out titles, I would just like to see him get fucked over too.

        How old are you? If you're a young guy, he probably thinks you're just some immature kid that he can scare into refunding his money. Don't let him push you around. This guy sounds like a major prick.

                  Get that title and have your release of interest notarized. Copy both sides for your records and mail the new owner the original via registered mail. He will have to sign to receive it and you get a receipt back as proof.

                  Next you need to get the tags back off the car. You need to turn them back in before/as you cancel any insurance coverage on the car. If the new owner refuses to release them to you, call your sheriff and ask for an escort. Hopefully you either kept the tags at the sale or otherwise have them in your possession. Once the tags are returned to your state, cancel any insurance on the car.

                  As has been said, you sold and they bought the car "as is" and you have that fact, signed, in writing. You need to finish the process as soon and as cleanly as possible. Do not respond to any of his threats and just hold your ground. If he decides he wants to sue, let him... you're in the right and he can pay for your lawyer and time spent defending yourself when you win.

                    nope! it was a younger (29) guy and his wife. the wife was the purchaser though.

                    I am 25 so not that young. I have been nothing but professional, and both times I met up with them I had business clothes on from work so I don't think I gave that impression. He is definitely a prick. Very threatening.

                      good advice, mostly.

                      EXCEPT for the part about getting the tags back. If he (the new owner) is driving on the PO's tags, then the PO is leaving himself open for all sorts of trouble- especially now that the new owner is trying to get $$ back from the PO.


                      NEVER leave your tags on a car that you have sold. If the person says they just want to leave them on there long enough to drive the car home, then they'll bring them or mail them back to you- then it's up to you, but I wouldn't do it. I would offer to drive the car to their house, then remove the tags and take them with me.


                      If you leave your tags on the car, and the new owner drives on them, technically and legally, you still own the car and any accidents would get charged against your insurance. Think of what would happen if the new owner drove the car into a crowded bus stop or drifted the car underneath a log truck. YOU would be the proud new owner of the liability that goes along with the damage done by the wreck.

                        So even after I do the title transfer my license plates could still get me in trouble??? thats wierd. I've bought cars, done the title and all and have used the existing plates for years. the dmv never told me to get new ones.

                          Just curious. How much under the usual value did you sell the car for? Can you go halfway and refund the buyer $500 for an unsuspected flaw (as a good will)? Your car was the AMG, right? I remember being tempted. If the tranny had died on me within the week, I would have called you back and ask for a settlement that pleased both you and I. Even if the car hasn't been inspected. Sometimes some trannies don't show any sign before dying. $500 is nothing to make peace.

                              If you give anything the guy will want more. He is already asking for money you dont owe. You make amends if you want to do further business but not just because a used car had an unexpected issue.

                              If that were the case there would be no used car dealers because they would have gone broke from refunding everyone their money.

                                In every negociation, each party wins a bit and looses a bit. Both end up on top. My view on the situation is to let the guy know that he has no chance at all if he goes to court. Explain clearly why. Then offer $500 to settle it and buy peace, under the condition he doesn't go to court and have him sign a "contract". He will probably refuse, go to court and loose. At least Aaron will have shown good will. Always have a witness to every contact and have the other guy sign the title when cashing the $500. That money is basically the bait to protect Aaron.
