    I have spoken my mind, and thats all I will say on this topic.

    At any rate its good to see how many people still pay attention to the world around them and just are not worried about watching the latest "idol" show. If you are not informed you will make uninformed decisions,,, just look at whos in the big white house at 1600 Pennsylvania!

      I dont see it as anything bad. You simply have to state that you want to remain silent. If you dont, anything you say can be used against you in court. Its the letter of the law. If you tell the cops, "I dont want to say anything, give me a lawyer" then the interview is over.

      In this case the guy was refusing to state any of that, its really just making it easier on the police because they dont have a mechanism to deal with people who refuse to be mirandized (drunk/belligerent/whatever).

        Thats the way it always has been!!!! You could end the interview/interrogation at any time by invoking your 5th amendment (aka Miranda) rights any time after you are formerly read them. Or YOU COULD JUST SHUT THE FUCK UP. Little tip do both till your legal counsel gets there.

        the difference this SCOUTS decision just made is that NOW YOU HAVE TO INFORM THE CONSTABULARY THAT YOU INTEND TO REMAIN SILENT RATHER THAN JUST SHUTTING THE FUCK UP PERIOD. Now you have to open your yap and say I am going to remain silent. Thats contrary to what you are told in the very 1st line if your Miranda Warring!!!!!!!!1 WTF really is that hard to get.

        Remaining silent is a RIGHT it says so every time you get arrested, you dont need and are not required to inform anyone that you wish to use them. The SCOUTS just walked all over the Miranda decision and is narrowed the scope of the 5th.

        How much harder is this shit to understand.

          No they did not.

          You can be silent, nothing changes that. But what this means is that if you stay silent for 10 minutes and then start talking, well, they can use it. If you say, "fuck off, Im not going to talk to you" then they cant use what you say after that against you.

          Its just formalizing the rule so there isnt that grey area where people could say, "no, I meant to remain silent but I was too stupid to actually stay silent. You have always had to envoke your miranda rights, such as an lawyer. Its not like they just provide one immediately, you have to request one. But you have the right to request one.

            If you are too stupid to properly use your rights, it's your fault. This is the watering/dumbing down of our society.
