Only, he didn't actually defend his house or family, because the gang didn't actually attack. He thought they might attack, freaked out and brandished a firearm. Now, as far as that gang is concerned, no matter what, he's a marked man.

Now, if he had mowed down some of these gangbangers as they broke down his door, not only is it legal, but justified.

I had a problem a few years ago when a neighbor I had been feuding with for years threatened me. I live in a country club and the neighbor is an old bully, he was 65 at the time, but 6'3" and about 240. He has a history of intimadation with village councel, I had been complaining about his dogs for years as they will bark till 2:00 am and back again at 6:00 AM. He caught me video taping the dogs barking and (tripod set up and dogs barking for 20 minutes straight) confronted me with my wife and 6 month old child in the driveway stating if his dogs are taken he will retaliate on my family as his is trying to poke me in the chest, So anyways old man is laying in my driveway bleeding and I call 911, they say he wants to press charges and because of his age it can carry a 5 year sentence. I refer them the castle law (love florida) and told them I could not retreat as I was acting as a barrier between him and my family. I stated he was lucky my gun was in the house or this could have ended much differently, they basically said have a nice day and no report was written. To this day there is nothing more than "disturbance report" at the police station with no reference to a fight. A few months later his Skinhead construction worker son knocked on my door, I answered that with gun on my hip, have not seen him since. 4 years later, dogs are kept inside!

The "Law" want's to get pushy but this is how victims are made. Good men, doing nothing. I'll gladly sit my ass in jail if it meant protecting my family. While it is an injustice, and I would urge those close to me to make a HUGE public scene about it, I would seek the best qualified attourney and see "the Law" in court.

That he was arrested at all is an insult. Those officers SHOULD feel ashamed of themselves. The Spirit of the Law and the Letter of the Law. Both have to be upheld. Not every case is less than 2 pages of report. You might actually have to do your job. Last I checked threatening someone could land you a slap on the wrist. What happend to the boys that can shave?

Sorry, but pieces of shit like that deserve worse than they get. While at any time in a one on one conversation I truly believe they could come around, when there's more than 10 guys in my yard, I just assume end that threat.
