    Def a state to state thing. But most if taken to court are not going uphold it if no services or products exchanged hands.

          If the seller wasn't a complete tool, none of this would have happened.

          That being said, if you ignore that fact, I think the buyer was in the wrong. I would NEVER put down more then $100 deposit on a car I hadn't seen in person. $1000 is insane.

          If the seller was a decent human being though, he would have taken the $200 he was offered and refunded the rest.

          Basically, I think both parties screwed up and both paid/ will pay for it.
