        He's claiming brake failure on his statement, but that's gonna involve a lot of due diligence on his part - proper brake maint records and BMW recall bulletins/inspection most likely.

          I doubt they will. My parents are hounding me to clear it with insurance first, but I mean common, the car is totaled, the pictures from the police report clearly show that. I'd rather just part everything out ASAP so I can get a new car quicker. Besides, I'm off for at least two weeks because my work doesn't want me back for liability concerns with my neck so I got to claim disability pay for that period.

                    I don't think mechanical failure on a 20+ year old car is going to matter. Its not like he can go after a shop who recently replaced everything associated with his breaking system. Poor maintenance just shows additional negligence on the owners part.

                      Considering I've had no reason to mess with the brake fluid for like a year, it's just a freak accident. I had proper braking power up till that day and my clutch was fine. Besides there is no need to mess with the brake fluid when changing pads and rotors unless you notice a leak and the fluid level is low, which it wasn't.

                        Your technically supposed to change the fluid on an annual basis. Nobody does unless they track their car regularly.

                              Yeah. Its a big waste of time and money. I had to deal with a few contested claims. Basically they pay Ken Herring several hundred dollars to do a visual inspection and press on the brake pedal.

                                And I mean shop receipts to prove a certified tech did the most recent work, not a 'kid with a breaker bar'
