if a burglar broke into your home and you shot him but did not kill him you would be tried for attempted murder... and lose. it's just how the law works.

you did not get hit. if you had the ability to avoid being hit then they will argue you had the ability to not be in the way of a dangerous vehicle. I know, it makes no sense... your money/lawyer might make it work out for you. i despise your initial intention and your lawyer's intentions and the driver that almost hit you.

Had to use the tolls roads last night for the first time. went online and paid the $7.35...

Now Im debating getting a transponder, but Im not sure if its worth it. I do drive a lot but I havent quite figured out if it would be worth getting, especailly if they will charge me a monthly fee for NOT using a certain amount each month.

GET IT!, they only charge a dollar and if you sign up through AAA it's waived (at least they used to). It's a prepaid account so as long as you load the right amount you won't really notice it. Depending on the time of day, there is little to no charge if you have 2 or more people. Or if you "forgot" to switch it to "1" person when you are by yourself ;). The cameras only snap the rear license plate. I wouldn't do it everyday of course. The important question to ask yourself is how much time did you save? and how much is your time worth to you? once you have it you won't really be able to live without it.
