I got pulled over tonight for Exhibition of Speed, the officer let me go with a ticket for Basic Speed Law, putting my speed down as 65 mph in a 50 mph zone. He didn't fill in the LIDAR box, and from the way he spoke he estimated my speed visually. The street was dry, the weather was completely clear, and there was only one other car on the road. How should I go about writing my TBD Statement of Facts?
Anyone have Trial by Declaration experience?

I typically go for trial by declaration to save time. I give a lot of details, circumstances, and diagrams/pictures. Just like writing reports for school. Worst case scenario is they keep your money and you get points on your record. Don't write anything that the cop can turn against you. Both times I've won by just writing not guilty. Cops get paid to go to court during their shift, they don't get paid to do paperwork.
The likelihood of a cop not showing now days is slim to none, but a lot of times they wont bother with the paper work.
Greg - extend the ticket online a few days before the stated court date. Then make sure to turn in the TBD sheet right before the renewed court appearance. By that time it's been over 4 months, the cop will not recall the details of the ticket like you will. Don't write anything that the cop can turn against you. Both times I've won by just writing not guilty. Cops get paid to go to court during their shift, they don't get paid to do paperwork.

Instead of going to court, you write a letter/paper/essay defending yourself to the judge. The officer against you has to write a letter in defense to your letter to the judge. Then the judge decides who wins.
The beauty of this is:
1. Officers usually forget if you extend it.
2. They don't get paid to do paperwork as opposed to going to court like polak said.
3. They are lazy to write it. (I'm pretty sure I would. I could care less.)
4. In the event he responds, and you lose, you can re-appeal the case by going to court.Comment

I beat my last ticket with trial by written declaration. The trick is to write as little as possible as to not self incriminate yourself and to get the longest extension you can so the cop can't remember enough to write a good statement.
Worse comes to worst, you can always get a second chance to fight it in court.Comment
