California OBD2 Swaps, Check Engine Light?

Do I need a check engine light to be able to get my car BAR'd with an OBD2 S52 swap? I have an '87 325e, so I don't have a cel at the moment.

The CEL needs to light when the key is in position 2 and then go off when the car starts.

So I need to install a CEL light I guess. Or swap over an entire late model cluster, since I'll already need a new tach.

you need it even with obd1. it's just a light bulb that's grounded by the dme.

CA referee's are notorious for being very invasive, by the book, front to back compliant with no "slack" to be given. It's their job they're protecting, (especially in this economy) so the word "meticulous" is an understatement. Of course you need a functioning CEL!
