    Exhaust ticket! Help?

    So while driving with my buddy in the e30 I got an exhaust fix it ticket. VC 27151. The cop was nice and could have gotten me for a lot more things. So, now I need a little help on how to get out of it without giving this California government my money that it is trying to steal haha.

    27151. (a) No person shall modify the exhaust system of a motor vehicle in a manner which will amplify or increase the noise emitted by the motor of the vehicle so that the vehicle is not in compliance with the provisions of Section 27150 or exceeds the noise limits established for the type of vehicle in Article 2.5 (commencing with Section 27200). No person shall operate a motor vehicle with an exhaust system so modified. (b) For the purposes of exhaust systems installed on motor vehicles with a manufacturer's gross vehicle weight rating of less than 6,000 pounds, other than motorcycles, a sound level of 95 dbA or less, when tested in accordance with Society of Automotive Engineers Standard J1169 May 1998, complies with this section. Motor vehicle exhaust systems or parts thereof include, but are not limited to, nonoriginal exhaust equipment.

    I haven't gotten all the information in the mail yet, but I believe i will have to visit a ref and get my exhaust tested by a decibel meter to see if its okay. If it isn't okay I will have to try something else, borrow someone else stock exhaust for a little bit till i get it signed off?

    Here are few important points
    1. The officer did not have decibel meter on hand, he did not test my exhaust to show it was to loud. HE ASSUMED it was.
    2. I can't use this in court, but the only reason he thought it was too loud is because I was hitting high RPM's and it was loud, but normally driving its not unreasonable.

        add a resonator, a cat, or a longer muffler. you can either fix it or pay the ticket, it's not rocket science. 95dba is pretty damn loud anyway, there are race cars at the local tracks that can still pass that.

            thats my exhaust getting close to the limiter. There's cars coming out of the factory louder than my car!

                OEM from factory?

                If it's been used alot you're baffles probably aren't working right anymore

                  I didn't think OEM was 3"?
                  I think a P.O. upgraded cause its pretty loud. I love the sound.

                      This is my exhaust, on the car it came off of before I bough it. Catback, no mufflers just two resonators (described as "twin twister mufflers"), only gotten one warning fix-it from a bored cop and I live on a college campus with cops everywhere. They aren't going to make you redline it to test, are they? I say call their bluff.

                        dude Love your sound! It's probably similar to mine. Did you just pay the fee for the fix it ticket? Get it tested?

                          Luckily (just so I avoided the hassle of fighting the ticket like the guy posted above) it was just a "warning" of a fix-it ticket and he didn't actually write me a ticket. I've been pulled over twice before, one for speeding and one for downshifting at 12:30am while making a quick left into a residential cross street (pretty loud I'll admit). Both times I was let off with a warning, the speeding one stern, the other pretty nice. They always ask "Is something wrong with your muffler" and I just say "No officer...". Too many bored cops need to be shown that this is just a waste of everyone's time and that there are a lot more pertinent offenses to be worrying about.

                              It may be a lot of work, but I just read through ~8 pages of the thread and he won his appeal after losing the district case. On page 8 (I think) he posted the arguments that were prepared by his law school friend of a friend. Could be very helpful to you and a good place to start. His extensive testing was rejected from being entered into evidence, so perhaps you wouldn't even have to do that aspect. A well prepared case addressing the exact citation you were served with may be sufficient to throw out your case, specifically if there were no tests administered on site (if required in your state/city, this is something you'd need to research) and that the officer used his subjective opinion to determine the illegality of your exhaust's noise level. Remember to orate well and be presentable in court (khakis, shirt and tie at least if not a suit) if you choose to appeal.
