True, but i was going the speedlimit. Which is designed so that at that speed i should be able to see conditions. But I obviously wasn't. Plus i don't know if it's a good idea to slam on your breaks at 60 mph on a turn of sorts, probably would of gotten oversteer for sure. Anyway u look at it IMO the city should of posted warnings to slow down for debri in the road or just should of gotten it cleaned up all the way.
I'm pretty sure the cop did the formula right there too. They usually have to analyze things like this to come to a real conclusion, which I'm pretty sure wouldn't be their priority in a single vehicle no injury crash. Moron.
Ok....I've just read all the post to this.....and Charlie makes the point well. 1) you were speeding....plain and simple. 2) despite your area's best efforts to keep public roads/highways clean and safe for the vehicles that use it.....there's always a probability that at some point debris is going to find a resting place in an area which is going to be a real inconvenience for someone given the ideal circumstances.
A few years ago I totaled an E30.....but I was asking for it. Driving too fast for the conditions (it had been raining) and I stuffed a very clean and low mileage E30 into a concrete wall doing upwards of 60mph. I fucked that car up royally. And in the end, there was only one person to blame....me. A tough lesson learned....I'm more cautious now because of it. What has happened to you is similar to my experience in some ways. Just swallow the bitter pill on this one and take with it a lesson learned the hard way.
Sorry to sound like an unsypathetic ass, but you choked dude.

First of all, I wasn't speeding. Second of all rain is way different, it's raining, it's all around you: you go slower. It was a perfect day, how was i supposed to know there was debris in the road ahead. Debri on freeway == accident waiting to happen. And it happened twice in 45 minutes, maybe more before or after. Don't tell me i choked. Not to put you guys down in anyway, but plenty of you woulda been going the same speed given the conditions, how on earth was i supposed to know there was crap in the road ahead. And I was going the speed limit.

I guess I'm the minority here, where I am agreeing with Matt.
I woulda been goin...well, probably faster than the speedlimit. And, it woulda caught me off guard as well. (I know...I know. :?)
However, I'm not sure if the blame can really be pointed though. However, in this case, there were TWO cars that had the same thing happen. You should try to contract the owner of the Honda, so you guys and be witnesses for each other or something - to help build a stronger case.
How can you claim you weren't speeding when you said yourself the ramp was marked 45 and you were going 60? Just because it's not technically speeding, it could be argued that the 45 warning is in fact the warning you're bitching about not having. If you were going 15-20mph slower, even if you still didn't see it, you would've had much less of a car control problem.
I agreed with Matt until about the end of the first page when it started to just become repetitive bitching.
You weren't speeding per se, but regardless if you could see it or not your speed was excessive and screwed you into the wall. Suck it up. Some examples, oh i was doing the speedlimit, but we just got a couple inches of rain in record time and crashed my car! Ohh but I wasnt speeding
Thats a bad example I guess... how about black ice. Its not the damn city's fault where ever "black ice" develops and cars slide out of control into a snow bank even if they were going only like 30mph or what ever (I dont live where it snows). The driver couldnt see the patch, and lost control. I dunno if i exactly would agree with a ticket in THAT case though because obviously people in snow would hopefully be driving more cautiously anticipating that and driving below the posted limit already. You just screwed yourself, it happens and thats why theyre called accidents. You can fight the ticket all you want, but its not the city's fault that you couldnt control your car.

This is true. But still who on earth actually follows these. They are for grandma drivers in cars with horrible weight distribution, e30s laugh at speed recommendations. Adam, I am agreeing with you here, i'm just pointing out that it sucks for us.

Yes, sorry for the repetitive bitching but just some people kept saying the same things and obviously hadn't read my post. And no i'm not trying to blame this on the city, i'm just trying to figure out what i can do or if there is anything i can do.

I agree with that, I speed myself too, and think speed limits are a little lower than they could be but it keeps some idiots in check with thier mammoth cars or anything else that doesnt handle any better than an suv.
Instead of making yet another post --

I understand what you're getting at and I'm not trying to bust your chops, it is just how it came across to me. Basically and unfortunately, I think the city or any sort of agency is off the hook on that one though unless it was conscious negligence to clean up everything whoever did so, or the lack thereof. As far as I can tell it was a legit mistake. I dont know the exact details and obv there are no pictures of the debris stuff, but a honda crashing not long after you seemed kind of odd. I dunno what to say about that.
but a honda crashing not long after you seemed kind of odd. I dunno what to say about that.
Yeah exactly. It even seemed like the cop was expecting it. He explained to me how there was a rollover semi earlier that dropped some debri. And told me to get in my car with the seatbelt on as we were waiting for the towtruck, he said in case another accident like yours happens again.
Is the concept of personal responsibility completely dead?
Completely.
Ok, so the ticket was overkill...you went through enough. Not to mention I don't really think this was a case of "driving too fast for conditions," even if Charlie's textbook definition fits it. It's just a case of bad luck, but it's not the city's fault. If you're driving and a tree falls on your car, is it the city's fault? No. Were you speeding? Maybe, but it probably didn't have any effect on the tree falling. Sometimes shit happens. You've got insurance, use it. Fix the car, and hit the road again. You can't worry about what's around every corner, life wouldn't be any fun.
Totally agreed with Beemerfanatik, and as far as the cop leaving you in the car thats just precation and it just so happened that someone else goofed while you were still there. Just like when you're getting a ticket for going a rediculous clip on a barren hwy I doubt the officer would have you wait outside your car just in case someone comes by and hits ya :)
I dont know though, asking here will just get so many opinions, mine is split because I dont have all of the details. If you really knew what you wanted its always possible to look into situations further, but more likely than not it would be a waste of time and resources. That is unless you just wanted to feel resolved whatever the outcome is. Fighting the ticket and getting out of that (a lot more likely than pointing fingers and not backfiring) would probably boost your mood relatively well.
who on earth actually follows these speed limits. They are for grandma drivers in cars with horrible weight distribution, e30s laugh at speed recommendations.
People with uncrashed cars follow these speed limits.
I'm sorry, but you really stuck your head up your ass on this comment. I'm a speeder. I love to speed. But will I ever claim that speed limits are for pussies? No. Speed limits are there for everyone, not just granda drivers. Those grandma drivers will drive 65 even if the speed limit is higher - so it has to be lower to keep you from doing 90 and coming up behind one of them. Just because your car can handle higher rates of speed doesnt mean everyone elses can. What do you want, a "sports car" lane, so people who have fast cars can go by their own speed limits?
You aren't the only one on the road, as awesome as our cars are they still have limits, and speed limits are there for everyone. Not just pussies. If you're gonna speed, man up, take responsibility if something happens. That's the price you have to pay, and if you can't, slow the fuck down.
