When the driver is arrested, the passengers legally become "pedestrians." The officer said because we were stoned and pedestrians now, he could arrest us for public intoxication (what the fack?) and also, ASHING your cigarette will get you a $1000 fine. I thought it was just when you throw your cig out (littering) but the physical act of ashing a cigarette on the ground is illegal. Ask me how I know.

In relation to this thread, I get profiled all the time. I'm close to 100% Italian but look Mexican with an afghan beard. I get way too much attention from Cali police.

I have driven high more times than i can remember but I dont anymore and i dont recomend it either. But if you are high enough to not pass a field sobriety test you shouldnt be fucking driving thats for sure.

Msport, I agree but there's other factors that railed him. It was raining, fucking freezing, 2am, and being pulled over is nerve wrecking enough. It was completely up to the officers discretion, there was no "matter of fact" such as a breathalyzer reading. I don't condone smoking and driving, but I do NOT think it's on the same level of drinking and driving.

yepp...told me my exhaust was too loud. but did absolutely nothing about it. just pulled me and my car full of friends infront of a liqour store asked where i was from and what we were doing. told him we bout to go to the bar. then he said okay have a safe night. wasted my time. -___-

So you honestly dont think weed an intoxicant? If a cop sees you visibly high, youre getting a DUI, brother. Plain and simple. Having weed on you is semi-legal with a card. But under no circumstances is it legal to be driving while under the influence of weed. WTF do you think being "high" is?
