Speeding ticket: Cops allowed to park on shoulder facing opposite direction on hwy?

I don't know where you live but in most cases the cops out on the highway and the ones in the city aren't even from the same department so your point is invalid.

You sped and you got caught. Stop complaining or saying "technically." It's not like it was some technicality. You were doing 20+ over the speed limit. Where or how the cop was parked doesn't have anything to do with that.

You can say it's for "income" all you want as well but that also isn't likely true. At least in MD all citations/tickets go to the general fund, not to some police fund. They aren't getting anything out of it other than doing their job. Stop speeding. Stop complaining.

I am sorry that your perception is of me "complaining". I am not trying to make this into an ranting or complaining thread as I believe that I do deserve the ticket that I got.

I say "technically" because the law is that if you speed, you get a ticket but I am taking into consideration the circumstances in which I was speeding. So that is why I say "technically I should receive the ticket according to the law, but.."

When I say income, I don't mean that it's going straight to the police department, I'm talking about it going to the state in general. And I also agree with you, that cops are just doing their job. I'm not complaining or saying that it was wrong for the cop to be parked the way he was and that it was wrong to pull my over. Cops can do anything that they want to do, legal or not. I was just asking whether it is indeed legal or not to park that way on the highway.

There is a reason they give you an option to fight tickets.

There are no fees to fight w/ trial by written declaration. You just pay the fine and if you win the send it right back. I have done this and so have MANY others, when speeding was evident (10-15+ mph over)

Speed limits are purposely set WAY too low so people can be caught speeding and so revenue can be made.

You broke the law, what makes you think your entitled to get around the law?

Highway speeds are set way too low in my opinion. Look at the autobahn and other European countries with less speed regulations. People who drive there are better drivers in general because of it too. That and probably also because there's less automatics. (So I've heard)

Then he proceeded to ask us if my boyfriend and I had been drinking, because "he could smell it". My boyfriend and I were coming back from a friends house after checking out his new 3D printer. We both shared one mixed drink with ice that we both slowly sipped on over the course of about 1.5 - 2 hours. So, it seems like there would be hardly any way that he could "smell alcohol" especially after 30 minutes of driving home. We both believe that the cop was lying when he said that he could smell alcohol.

He then proceeded to ask more questions, "Where are you coming from?", "Why are you coming from there?", "Where are you heading?" But I'm sure a lot of cops ask these exact questions and whether you have been drinking to try to read people and catch them or something.

Is that some sort of entrapment?

I don't see you complaining you said you were speeding and owned up to it. Never once said you were sicking Mom and Dad after them with family lawyer. You could always make a call to the state police and ask for some clarification.

lol, the act of speeding is already done, which is why he pulled you over. That's not entrapment.
If he believes you have alky in your blood from just talking to you, he can use it against you and pull you out of the car.
It's not entrapment because the crime of having alky in you is already done. He's just being suspicious from probable cause = you smelling.

Again, entrapment is when they try and persuade you to do something illegal when you wouldn't of done the illegal act on your own without influence in the first place. It's hard to prove in court to begin with.

I happen to think that it's a good thing that cops ask questions like this, to read how you respond and get a feel for ya'. Cops will always ask you questions in a way for you to answer stupidly, admitting guilt.
When a cop asks how fast you were going, never admit you were speeding. Just say you were not aware how fast you were traveling or you were going the posted speed.
That way he can only tell from his judgement how fast you were traveling, or if he had a radar. NEVER ADMIT GUILT.
Cops will always try to say they smell something like alcohol or weed to try and see if they can hit you with more violations. Unless of course you actually were drinking, which then that is your fault.

Half the game is them seeing how you respond/act to them from my experience.

I was being an idiot on the road with an e92 M3 hitting maybe 90 +/-.
3 cruisers pull me over and let me go after them asking me questions and figuring out WTF was I doing.

Second time, I was pulled over and told to open my hood. For being in CA, I had all sorts of illegal shit in there. I casually cooperated and he talked to me for 5 scary minutes about it pointing everywhere.
Then, ended up talking to me 15 minutes curiously with questions complimenting my shitbox.

Just cooperate is what I've learned. If you're effed, you're effed.
