body shop gone AWOL need advice!

    I'm out of the country so looking at anything is out of the question, or at least until I return. I've since talked with the property owner and he said he would pass my information and talk with the leaser concerning my property.       yes I plan on installing lo-jack and an alarm on both my e36 and e30 when they are completed. Already have one on my e46

        I return home in less than 10 days. If I don't have positive feedback to include pictures from the shop owner and the guy doing the work before I return I plan on paying them a visit. If I cant get ahold of the leaser then ill request from the property owner to open the unit to pull my car and parts. If that doesn't work or if anything is missing then I will call the police.

          its not a regular unit, its an office workspace unit. And the owner said he would reach out to the leaser which at least should imply that he still has contact with him and is in good standing with the lease. Which would then imply nothing has been auctioned.

              If this goes sideways you'll wish someone credible like the police dpt. had some sort of documentation about this early on. There's no harm in asking the police to take your statement, have the situation on record and not take any action at this time. You are far more trusting and patient than I, or you have the resources to replace an m3 at will.

                from a legal point of view , nothing illegal has taken place. Unless you call not responding to emails illegal. Regardless of the shitty situation I would be lying if I said it has been stolen because I cannot prove this without further investigation by myself. To this point, I have no evidence of any wrong doing. If I cant get ahold of the leaser then this will add to my suspicion that foul play may be involved which would justify me contacting the authorities.

                    as stated, I said any advice is appreciated. Nothing within this forum says a member "has to take advice". And I have been doing something which is more than what you have provided me with. And I apologize that you are so frustrated that I have not contacted the police that you feel that this thread should be locked. Maybe you should go work in Afghanistan for awhile and be disconnected from everything that you own and from everyone you know back home. Then you can relate as to why I have been waiting to return home to proceed with further action. And to say that someone deserves something negative happening to them isn't that polite either.

                    Hope your doing well. I have not heard from you once in the past 2 months. My car has been apart in a sufficient amount of time to allow you to have everything completed. Since you have had no contact with me I cannot say whether my car is being taken care of or not, whether it has been stolen, parted out or etc. I have contacted the owner of 110 W Seneca Ave Unit 118, Tampa, FL, a Mr. Scott Calderazzo and asked him to pass my contact information to you and John. I will return home in less than two weeks. If I do not receive a valid update between now and the time I return I have asked Scott Calderazzo what documentation I will need to provide to him in order for me to retrieve my property without the leaser being present. I'm assuming the leaser wont be present because I have had someone go by the address at least 4 times now and it has always been closed. If any of my parts from my car or parts that I had shipped there are missing then I will pursue legal action to recoup my lost goods.

                    If you receive this email before I return and you wish to continue working on my car, please provide an update and proof via pictures on that work has been completed within the last two months on my car (1988 BMW M3 VIN xxxxxxxxxxxxxxxxx).

                    If there is no response to this email, then I am using this as proof of documentation giving xxxxxxxxxx the authority to pick up my car and other parts in my presence.

                    Please respond immediately as I wish not to contact my lawyer or the authorities in retrieving my property.

                        this is nothing compared what ive been through before. Has your wife left you while overseas, takes all your money and deserts your house when you return to a messed up house with dog shit everywhere and two months behind payment? I have two other M3s and a plethora of other toys, and well paying job. And there's nothing I can do physically about the situation from half way around the world. It does no good to stress about a situation you have no control of. Ill take care of it when I return.

                            Its a small world so maybe you shouldn't assume things. I was in Kuwait for 14 months as a civilian contractor...while my wife gave birth to our first child.


                            Now go call the police and file a report and stop wasting your time online asking others for advice.

                              You don't have to be in Florida to give someone that you trust power of attorney. You also dont have to be in Florida to call the Tampa police department.

                              Sending him letters only gives him more information on how to dodge you. Now he knows he has 2 weeks to skip town, 2 weeks to blotch your car back together, 2 weeks to make sure your car is no longer in the storage locker when you get there. He now also knows not to answer calls/correspondence with Mr.Calderazzo, which the police could have used as an asset to get ahold of the leaser.

                              The onus is not on you to prove that your car has been stolen or mistreated, the onus is on the person who has your property to prove to you that he has not stolen/messed with it. It is reasonable to believe that your property is in danger if you lost contact with the guy TWO MONTHS AGO.

                              No one says the police needs to go down there with a SWAT team to check on your car. Call the non-emergency line at the Tampa police department and have a cruiser swing by and check if your stuff is there, if it is go from there.
