I would compare it to forcing people to retire due to their age. If someone is doing their job well and meeting expectations in performance apraisals, why should they be penalized for an inconsequential matter? Suppose the most professional, all-star 24-cars a month sales advisor tests positive for multiple drugs. Are they going to fire the person?

Bottom line: If someone isn't doing their job, fire them. If they are, leave them alone.

that doesn't matter.. dogma states that drug users are evil and incapable of leading normal lives. Even though caffine, nicotine and alcohol are also drugs that are widely used legally.

Working in the private industry, a random drug test is completely legal. Some may argue that its an "invasion of privacy" issue, but the fact of the matter is a company can do this and not violate any laws. I reviewed my personnel policy manual (I work for a corporate law firm) and they clearly state that random drug testing would be done at the company's discretion. However, I have yet to be tested and I've been employed here for several years now.

I think (in the case of my employer) they would only consider random drug testing if there was an issue with employee performance or frequent absences from work. Seeing that all we do here is answer phones and push a lot of paper around, its not nearly as risk-oriented as working for a car dealership where pricy personal items (i.e. BMWs) are being worked on or driven around. There's just more at risk in the latter hence a greater reason to CYA.

That sums up exactly what they should be doing. Peoples personal lives should be considered separate from work. Once their outside problems affect work thats when they should be punished.

Your friends were better off failing the test than not taking it.

Legally the company can test you in a "Right to Work" state. The catch is legally a drug addiction, like alcoholism, is a disorder. That means a company cant fire you, they have to allow you to choose rehab. That gives you plenty of time to find another job and fuck them by not showing up one day.

I know this because I worked for a subcontractor in the Right to Work state of Kansas. We couldnt fire druggies, had to send them to rehab first. Then if they didnt go they got fired (most didnt).

We stopped doing it because of this and the cost of drug testing. I couldnt imagine how much it costed your company to do it.
              Im now E30less.

I'm pretty sure it's legal in AZ, we get drug tested at UTI randomly. This is a good thing though it helps sort out the dip shit kids that have no reason to be there, they just interfere with everyone elses training.

Yeah cause if you do drugs you are just in the way of anyone else right? Your like a drug free america commercial. You seem to leave out that there are just as many stupid as shit sober people as druggies. Random stupidity tests should be mandatory, drugs or no drugs.

DITO!!! FUCK YOU DRUG ASS USING MOTHER FUCKERS. You increase the cost of workmans comp insurance. You increase the cost of auto insurance. You increase the cost of life insurance. You kill innocent children driving under the influence. You kill innocent children by distributing, even by giving the hit or freebe. If you ever cause injury or death to my babies you better hope you go to jail quickly and get your fuck up the ass by Bubba and Billy Bob because I have no heart for this crap. I would treat you like the fly. Pull your legs and wings off by visiting the cage and letting Bubba know you are a baby killer. Then when you get out and I am tired and bored with inflicting pain upon you through others, have you ever watched boxing hellena? My babies are my life, You kill them I would have nothing to live for except to kill you slowly. It only takes one trip to the store to get chips after a smoke to create a problem. IF YOU HAD A 5 YEAR OLD DAUGHTER AND SOME SMOKED UP POT HEAD HIT AND KILLED HER AT A STOP SIGN , WHAT WOULD YOU DO. No one that uses stays locked in a room untill the effects are gone. period.

whoa there.. also, there's no proof of any of this. Alchoho is probably 1000x the cause of these things than smoking weed is.

plus, not everyone is a dumbass and drives under the influence.. sheesh.

If they knew the policy, then hey they should accept the consequences. Maybe now they can go work on old VW's and Minis all day, smoke their lives away for a shop that doesn't give a shit...AKA dead end job.

                                Wow, eloquently stated

schnitzer teil-jäger, if I were you, I'd be a lot more worried about someone who's been drinking and driving than someone who's been smoking. I doubt seriously that you've never driven home from a bar after a few drinks. Alcohol is much more dangerous than marijuana. And as far as hitting your children, it's a damn stupid thing to let them play in the street in the first place.

Anyways, I believe it's ok to test randomly. If you can't accept the policies of your employer which prohibit drug use, you shouldn't be working there. You agreed to follow their rules when they hired you.

That being said, I don't think that recreational drug use is a problem, just so long as it is just recreational.
