    Hey if I get to part it out sure, Im not sure if that will be an option, or what. If its totalled it will probably be sold to the insurance company or whatever... The guy who hit me admitted fault on my insurance adjusters recording. But now his insurance adjust is denying it.. Also the boys "mother" called saying her son didnt tell the truth on the recording LoL.. I say to late, its recorded, he admitted fault, which should be the end, but obviously AllState indemnity are being d*ckwads.

      Usually you can buy it back for cheap and maybe even snag the stuff off while no ones looking! lol

        Also, if you have a shop or body shop that you've worked with in the past handy they can often write up a statement saying that the car is worth more than the blue book value (mods, condition.) My insurance tried to shaft me and total my car but I fought with them and had a statement written up by the place I bought it from explaining how it was in exceptional condition despite the high mileage and was therefore worth more than the total repair costs. Just a thought, good luck man!

            good luck man.. insurance companies are dicks. I got hit by a big rig driver that fell asleep in December, and because he did not speak english and the cop that did had a thing against "young people" or something... I'm now in the process of appealing the fact that is MY fault (that is what police reports says). NO matter what happens, my insurance goes up.. isn't that some shit?

            Good luck again, accidents suck ass.. even whent hey are not your fault 100%, its just annoying to deal with!

            ps- lol to the play-by-play NFL style markings on the pics, I could almost hear john madden in my head.

              LoL at the John madden comments, but yeah I think the cosmetic damage can be fixed and not cause the car to be totaled, I'm just concerned with any mechanical damages up underneath the car, obviously the control arm on that passenger side is bent up. I'll hope for the best, its not even drivable so I do not know how the insurance adjuster who determines if its fixable or not will look at this case.... I hope everything works out! That other guys insurance are definitely being the utter most assholes with this situation.

                If it bent the strut tower, its totaled. Dosent look too good to me, sorry to see that. I ahd to fight with insurance last year over a 91 318is that i ended up getting 3900 for. Bout a 10-15mph impact, but the tower got bent, and that was that. Took nearly a YEAR to get my money.

                Go get a rental car, its your until they settle on the condition of the car [which could be a few days or a few weeks]

                    hey thanks for all the compliments and help guys! As of now my insurance company Nationwide said since the other kid has a lawyer and I only paid for liability insurance that they no longer will fight for me, I must go to small claims court.. Im totally clueless about this whole situation, Im probably just going to sell the car as it is, I dont have a place or time to part out peice by peice. What do you think I could get for the car? Engine is 325, 142k on the engine, no issues with it, new radiator, I dont believe it was damaged at all I'd need to inspect further, its automatic rebuilt 14k ago shifted perfect, everything else on the body is flawless except for the damaged peices, no dents or dings. Ugh, this whole process sucks.

                      We seriously need to put together an R3V Special Response Team to go after the dumbasses who damage our precious e30s and then won't cough up the dough. It would be cool, we could all roll up in slammed black e30s with really dark tint and then beat the living crap out of our target and speed off. Sunglasses would be a must as well...

                        Yeah, I could reach through the phone and choke that guys insurance adjuster, she has a been a serious bitch from hell. Looks like I will be playing lawyer in small claims court... oh joy... never been there so it should be annoyingly amusing.

                          i thought if you must take the damages to small claims court, you can also sue for costs (ie. lawyer, court fees, etc.)


                          was there a police report or witnesses (sorry if u stated, forgot already, will reread) to help back you up on ur case? otherwise its ur word v. the kid's.

                          also.. they kid won't just cough upt he dough?

                            The police report says the kid told the cop that he "didnt see me" that "someone motioned for him to come out". Obviously he wasnt using the best of care and attention before pulling out in front of two lanes of oncoming traffic. He also ADMITTED fault on my insurance companys voice recording of what happened. As far as witness there are none except for the passanger of the kids cars. They are being stubborn as hell, I would honestly feel morally obligated to pay, if it was my fault as obvious as it is this kids then I would pay up and save the hassle. Some people can just be d*cks.

                              f.y.i. in california the speed limit is the limit but it applies to road conditions as well. traffic,weather,etc... safe to do so manner. if traffic was backed up & your goin in the left turnin lane which is free to make left turn @ 30mph...
                              story short, you maybe cited for unsafe speed for conditions in cali-fo-nia-. as schwarznegger would say.

                                Hey, I probably struck the guy at about 15-20mph after my short short braking distance. 30 mph was definitly safe given the road conditions in a 45mph zone, They are saying I was using the left turn lane improperly which is bogus, I as using it to make a left at the intersection, its intended purpose. That lane extends quite a bit, thats why you can have that speed, plus I was going on an uphill incline thus needed to use the accelerator.
