That shop is about 10 minutes from me. I have never heard of them and they are not known in the BMWCCA at all hear in SD. If I where you I would pull the project immediately and pay very little money with the threat of a lawsuit. I just did a Google search on them and they just started the shop 6 months ago, they are hurting for work and the rent is high so the guy is probably depressed and not wanting to work at all.sigpic

Definately heed Blunt's advice - sit down and write (or type) every communication you had with this guy and what was verbally agreed on. An extra step would be to make copies of your cell phone bills with all the calls you've made highlighted to substantiate you attempts to communicate with the shop. Contact the BBB and educate yourself on your rights as a consumer.
Bringing your father down the other day is helpful too....he's a witness to what's going on. He can help verify whatever you wrote down as far as what happened that particular day. Get whatever documentation on the car you have (prior receipts, title, etc.) to show you have records its yours. Once your papertrail is assembled - chronologically is best - then contact the authorities and head down to the shop. You may want to even go so far as having a means of towing the car home somehow should it not be running. AAA towing....friends' truck with trailer.....something, but have it at the ready when you go to pick it up.
As was already mentioned, when you make this visit with the cops, you want to make its your very last trip to the shop.....ever - and be sure you get everything that belongs in/on your car before you leave. Because you're just on a verbal agreement for the work performed and no receipts, you might have to eat some of those costs. But at the very least try to get your car back home then proceed with finishing the work elsewhere.

John Hennesey is well-known as a Viper supercar builder, much like Lingenfelter is/was to Corvette's, but Hennesey has a less then stellar reputation regarding his business practices.
No doubt he builds fast cars, but once he has your car and your money, you are at his mercy and he can be hard to get a hold of and has held customers cars for several months past the promised finish date and comes up with every excuse known to man based on cash flow problems mostly.
He has been sued dozens of times by clients and has had numerous judgments against him.
Read some of the Viper boards and you'll know who he is.
He even bad-mouthed his clients on message boards, called them liars, etc...
I've heard he's cleaned up his act recently, but I wouldn't trust him with my car, let alone a $100k car based on his past antics.

Ask him to give you a reasonable date as to when your car will be finished and the work performed satisfactorily.
If he misses that date, then you take him to court.
No more excuses, no more delays, no more BS
Tell him if he doesn't finish it in a reasonable time period, you will sue for time lost from work as well and anything else you can think of.
I think the limit now if $5,000 for small claims court, and I don't know all the details of your case and the value of your car and the work performed, but this might get him motivated to finish your car and to do it right.
I've been in your position before and it sucks. I had to bug the guy every day to the point where he preferred to finish the job then to hear me ragging on him on a daily basis.
Most likely, you're not the only one he is stringing along, so the sooner you can get a judgment against him, the more likely you are to be re-reimbursed if things go bad, which they sound like they eventually will with this guy.
He's most likely going to go bankrupt, as it sounds as if he is using new client money to finish jobs of existing clients, and as his reputation gets work, the less business he will get and some people are going to get screwed.
Document everything, take him to court, get a judgment.
That way, it will motivate him and if he goes under, he is legally bound to pay you and you will get priority over the people who didn't take legal action.
Keep in mind if he does go bankrupt and you do get a judgment against him, it may take years to get any money out of him, if ever.
I worked for a dot.com in 2001 that went under and it took me over 5 years to get the money owed to me, and I only got about 60% of it.sigpic
