Precisely. They created an entire page in their magazine for free using someones photos they did not ask permission for. Not only is it unethical but it is unlawful. I'm sure it's not the first time and you know it won't be the last. What they should have done is ask permission and at bare minimum offer a year or two subscription to the magazine for the use of the photos.

The page is a once a month thing for the magazine. They dedicate the page to what they would consider "very useful BMW enthusiast websites" This particular issue was targeted at Bimmerworks.com. All they were really doing was posting images directly from the bimmerworks website. Not just randomly posting images from the internet like you're making it sound.
So if anything, this is an advertisment for bimmerworks that they may have paid for, and gave the magazine rights to. So, if someone would have a beef with anyone, it would be the website for releasing the photos to the magazine.Last edited by Jonny Cash; 12-25-2008, 08:46 AM.-Jay

Hold on. I think you may be getting ahead of yourself.

I just think its crappy when something cool like this happens and the first thing someone thought was man wounder how I can make money off of it.sigpicComment

see thats the problem thats not what happened, Mr. anderson asked a question sparked by the topic but not directly related. People miss understood and went off. But now it has become a discussion about the legality of what happened.Comment

Seriously, some of you people suck at life.
I think its fair to say that you guys need hobbies.
Thats cool as hell that you made it in the mag, damn shame these dickheads have to turn it negative.Comment

seriously? some of you guys need to read the thread and try to understand the points that are being made from the stand point of those of us who derive an income from creating photography an imagery just as whats displayed in that page.

The answer to your question is yes! Im very serious, Ive done a bit of photography in my time so I can relate.
But on another serious note, you suck dude, so does speedminded.
The mag took pics from a site, and the other pics they had of his car were before he even owned it. He is excited, THIS I KNOW, but he might very well be the one and only example's of this happening to one of us e30 guys as I doubt they would want to do it again, if they caught wind of this which is in fact very possible.
So in essence, thanks for ruining my shot to get a random suprise lookin in PBMW one day.Comment

i mentioned that they did indeed take the pics from a site and that in itself is a totally different issue. I think this is getting blown out of proportion and you should watch what you say formula, because up until you entered this thread it was a civil discussion about the topic. Now your are mud slinging and name calling when it has nothing to do with what is being said. Stop being tough and add something insightful or get out.
anyway i think im done with this topic. It comes down to those who understand making a living from commissioned art and those who don't. Again if this happened to me and my cars i would be uber stoked, but if i opened this same mag and saw an illustration of mine with in their pages, one that i had publicly posted, i would be super pissed. magazines need to know they can't get away with this, and if it isn't ever brought to their attention they will continue to do it until they have a problem.Comment

It's www.bimmerwerkz.com, and no, they didn't know anything about it.
Those pictures are from when I had the car, thank you very much... (check the license plate, erik had "NOT SAFE".)

Thank you. There's so many people in this world that think they should get something for nothing, like they're entitled to something automatically. It makes me sick.Comment

Read what was said in the original post...
Example:
I'm photoshopping an advertisement banner for a car forum and found a photo on images.google.com that I would like to use as a background image on it. Sure I can right click-copy then paste onto photoshop and continue to make the banner but that would be copyright infringement. A simple e-mail asking persmission to edit their photo into a thumbnail size version to be used for a small internet banner is all that needs to be done.
You simply can not use other peoples creative work without their permission, it's not that difficult to comprehend.
