My cars - Performance BMW Featured... ALL of them

So, there I was, perusing the latest Performance BMW. My rusty car was featured in there before it was mine, so I like to look in there every once in a while to see what other crazy stuff they feature.
I'm flipping all the way through the magazine and in the last couple pages, happen upon this!

All of my cars!! LITERALLY MY CARS IN FRONT OF MY HOUSE!! I guess they found my account and took some of the pictures that I had hosted and decided to throw them in there.
Needless to say, I was flabbergasted, honored, and bought the magazine.

As a side note, I've always wanted to get my cars in a magazine, so this is a dream come true!

On another note, isn't that illegal for them to just swipe all of your pics off of your private hosting and publish them without your permission?

and thats pretty awesome but i think there is defiantly some copy right stuff going on... although the pictures are out on the public interwebs with no water marks or copyright so actually i think they can do what they want...

Doesn't matter, every image or creative artwork is automatically copyrighted material when it's created by the artist/photographer. Just because something is publicly accessible doesn't give everyone the right to use it.

OP, send them an invoice with a note that says "I'm glad you found my photographs suitable for use in your magazine (month/year/page), attached is my invoice and if you would like to use them or any others in the future please contact me at..." They will have no choice but to pay it or they can be royally screwed in small claims court. I understand you being excited they used them but DO NOT let them get away with stealing photographs.

Since it's editorial use the value of them are lower than, say, advertising for instance. The value is dependant upon the circulation of the magazine, use this calculator to determine the photo value....

I have heard that although your photographs are automatically copyrighted when you create them, if they are not registered with the copyright office before an infringement occurs, there isn't as much you can do legally if someone uses them.
