    Incident with the Virginia State Police from last May

    After reading the story about being arrested for sleeping in a car while intoxicated, I decided to share this incident (or summons) that I recieved in Fredericksburg County, VA whilst on my way to V@V.

    Left CT at about 3:45, picked up my buddy down the street and headed down. Went through NY, NJ, PA, MD & WV with no trouble at all, now fast forward to about 10:30am.

    As soon as I hit I-81 in VA, I see a ton of people being pulled over on the opposite side of the highway. About 20 minutes in, I see a car pulled over by 2 State Troopers. I am in the right lane (2 lane highway) and though I could have moved to the opposite lane, I reduce my speed from 70mph to 45-50mph when I go by them. Almost immediately as I pass, one shoots out with his Sirens blaring and of course pulls me over.

    Now, here is where it gets good. He comes over starts talking, says that I should have moved over, etc. while I explain we don't have this law in CT, there were no signs indicating it when I entered Virginia, I was very sorry, etc. etc. So he goes back to his car and leaves me there for about 30min. while he writes up a ticket, or at least I think it is. He comes back, hands me the ticket and asks me to step out of the car.

    I comply and go to the back where I am asked if I have drugs on me, and that "just a little bit is ok, we are looking large amounts." Yeah fucking right. I probably wouldn't have complied on normal circumstances, but I was so pissed for being stopped for so long I say go ahead, I have nothing to hide. So, he starts searching the front portion and after 10min. decides to call in a drug dog. yay!

    Now, when I get the ticket, the cop says "here you just sign this, all you have to do is call the court and just pay a fine". Mistake #1. Apparently, I was given a summons for failing to yield to a law enforcement vehicle. In VA, this is considered a Class III misdemeanor reckless driving charge, which forces me to appear at court in VA this month, and can result up to a $2500 fine.

    All for not pulling to the opposite lane. I never want to drive through VA again for this very incident. Fuck.

          I wanna know what was going through that cops head? Like whaaaA? You seemed like you handled the situation very politly and nine times out of ten that seems to defuse the pull-over. But this cop seemed out to get you i mean what? searching ur car, after you've clearly done what he's asked? (did you have any drugs in there btw?)

            Thanks man and I had no drugs whatsoever, just a bottle of patron in my buddy's backpack. I am always polite and apologizing when I have been pulled over.

            I can tell he profiled the shit out of me because I have long hair and a beard. I looked like a fucking hippie driving a BMW.

              Wow, the officer actually said that a little bit of drugs was alright, that they're "just looking for large amounts"??? WTF??? Virginia has always been one of those weird fucking states that you try to avoid during road trips (e.g. no radar detectors allowed, "speed enforced by aircraft," etc.) but this is just odd.

              Were you the only car that you saw that was driving in the right lane at the time? I'm completely unsure why the cop would pull over a 90's burgundy BMW wagon, but I guess he felt like making an example (or meeting his ticket quota.)

              It reminds me of a time where myself and a few friends were returning from Atlanta in my friend's B5 S4, we go through this desolate, remote stretch about 20 miles from my town and we get pulled. The officer comes up to the window grinning like he won the lottery and says "one hunnerd! you were going one hunnerd!" He seemed almost jovial about it, but the driver convinced him that he was definitely not going 100 mph. So, the officer returns to his vehicle (Crown Vic IIRC) and calls for back-up (another Crown Vic and a Tahoe drug vehicle thing.) They search the trunk and the cabin, inside the cabin is another friend's camera loaded with numerous burnout videos and other illegal/stupid activity that the drug brigade thankfully overlooked. The only thing they asked about was the heavily worn tires, "why you got racin' tires on this thing? are those legal?" was the question that the owner of the car quickly answered. It was an odd scenario, but the officer was telling us that the area had a heavy drug problem and I guess a black Audi S4 was the obvious drug cartel choice. We received no ticket and were on our way.

              Getting back to your situ though, hopefully they won't award the maximum penalty since both of you complied and explained that there really weren't any signs addressing this procedure. If there was alot of traffic through that area at the time, that will help your case.

                I've heard of people haggeling cops for consent to search. Such as you get pulled over for what you did or tints or whatever, they wanna search you, say you consent if they drop the original charge. I dunno how much truth is behind this claim, care to comment R3V?

                O and I drive to SC alot, wich means thru Virginia, those are the biggest asshole cops ever, last time we took my buddies foxbody down, we had a trooper riding our ass for about half an hour waiting for us to do something wrong.

                  we have that other lane law in florida too. That law saves cops lives, can't tell you how many times I see that shit in the paper of a guy getting hit on the side of a highway. It sucks that the cop was a douche like that, but its a valid law. 45/50 mph could still kill a guy.

                    If they want to search your car let tell them you will comply when the have a warrant to do so. If they had probable cause they would search you right off the bat, hence his question about having just a little bit of drugs!!!!!!!!!!!!!!!

                    That late at night he better have a damm good reason to need to search you, to call and wake up a judge to get search warrant. Its more than likely a bluff.

                    Never surrender your rights for any reason you have them for a reason.

                      not sure if this is everywhere, but in florida they can search your car except the glove box and trunk. If you refuse consent, they can impound your vehicle. Worse is if they ask to breathalize you and you refuse, immediate license suspension of 6 months ( could be more now, this was when I took my license test 6 years ago). They don't fuck around, lol

                        If you get pulled over for DUI yes you have to blow due to the fact that complying with that is a condition of your License in most states.

                        I dont know why in FL they can unreasonably search your private property with out Probable cause. Are you sure its not just when stopped for suspicion of DUI?????

                        If that is not the case I will not be going to FL unless I have to

                          or the cops could just do like they do here, and approach from the passenger side and not stand on the road. I usually move over anyway if there's room.

                          in Alberta you have to slow down to like 25mph if there's a cop with his lights on, and it's a $500 ticket if you don't. Dumbest law ever, it just about causes a multiple car accident every time somebody gets pulled over.

                            Appreciate the input everyone and yes I know my rights. Sure I could have refused, but the simple fact was if he was that much of a dick to me then, how far would he have gone to fuck up my day even more? even the effing drug dog jumped on my car, which made the other 2 officers giddy.

                            So even though I was clearly aware of the officers, had complete control of my vehicle, and still slowed down to under the speed limit, that it was a valid ticket? Getting a ticket and paying a fine is one thing, having a reckless driving misdemeanor on my record is another. VSP can ead.

                              Not that it would have made the situation any better, but I would have been furious. I am guessing there are a bunch of scratches on there now, and I'm also guessing you are S.O.L. because there probably no way the state is going to own up to the fact that fucking Fido shouldn't be jumping all over people's cars. Fuck man, that is brutal.
