UPDATE: Just spoke with Denver PD, advised that they do not do post-accident/collision police reports (for good reason IMO) also, i was kindfully reminded of the stiff penalty for not having insurance in denver. (up to 800-1000 dollar fine)

He also advised me, that since no police were called, this is a civil matter, or me vs her, or me vs her insurance company. so that sounds ominous.

Her insurance place just called me, i told them i'd call them back on my lunch. fuckfuckfuck

From my experience, parking lots are "no fault" areas typically since they are private property. And when it's not your fault (at least this goes for cali) it doesn't matter if you are insured or not. That is a police matter and is none of her insurance companies business. So don't let them bully you into settling if they say you are uninsured.

you are more than likely 50% fucked. in a parking lot collision, you share 50% of the responsability because the fact that you were there. that is the insurance company's point of view. basically you pay for her's, she pays for yours. it is not fair, but that is the way they play that game. i was in a similar situation years ago when some 16yo kid hit my rear bumper as i was backing out. i saw him comming, stoped and he was flying and hit my bumper and drug it down the side of his car. i bought new trim, buffer out the paint transfer, good to go and waited to hear from his company to submit a bill and called my insurance to tell them what happened, just in case. after making a claim and hearing nothing for 1 1/2 weeks i called and was told that i was 50% at fault???
called my people and she told me that was SOP for a parking lot hit because the police wont do a report. she told me she had been hosed in a similar way and was now careful as hell in parking lots for the same reason.

well, at least the qtr panel isn't fucked, that woulda sucked. just need a new tail light, and some paint on the left side.

i'll call her insurance when i get off, too much crap goin at work today. gotta love mondays.

yea, you should have just kept it on the DL and told her to give you a hundo or something. Youll be lucky if the insurance company doesnt pursue a civil action, it will probably be dependent on the amount of damage her care ensued. I work for the state (Arapahoe) and we take vehicle insurance issues very very seriously, max penalty in id say 60% of the cases. try to talk the lady into cancelling the claim (if they can even do that).

i shoulda gave her a bad number, but my license plate number was right in the pics, she took two pics as well, so i was already "Caught"; right? and she maintains that she didn't hit me, most notably quoting, "I saw you".... i saw you what? i asked her if "she saw me backing into her" and she said no, so then i asked her if she saw me as she was fucking backing into me, and she started to chuckle.

ugh.

and my insurance is notably more expensive, turns out i had a ojw from a ticket in denver that was unpaid, and i wasn't even aware of it until recently, hence me paying that off and being broke for insurance. i might just speak with the insu lady, see what she has to say, and offer nothing incriminating...

For future references, grab her license plate and whatnot if she doesn't give you her insurance info.

insurance will not cover this accident, but it will put you in a better spot to deal with her company.
