I have a .38 special that's registered in my name and I have no idea how to sell it. An internet search has returned conflicting ideas. I want to make sure my name is no longer associated with it. Thoughts?

In texas you can only legally sell a hand gun:
-at a gun show to either a dealer or to an individual (a transfer is not required, but I would get their name and driver liscence number, and keep a record of when and where you sold it) (this is the "gunshow loophole"). There are gunshows at the George R. Brown or Pasadena Convention center just about every month.

Entirely depends on state laws. In PA, for a handgun, you'd need to go through an FFL, even in a private sale. In Louisiana, like Restoman, you just do cash and go.Comment

What you have describe is a PRIVATE TRANSFER period no loop hole at all. Any one buying a gun INSIDE the gun show still has to undergo the FBI instant background check just like any other retail gun purchase
These laws vary from state to state, what you can do in TX is not legal in CA or MI or NY and what not.

Depending where you live this might not be possible. In MA, for example, every firearm you've ever owned stays under your name forever, even if you've sold it. Basically if you've had 50 guns in your lifetime, you have 50 guns to your name, even if you only currently possess one of them.
I wouldn't be surprised if CA has the same sort of bullshit policy. Either way, you're best bet is to go to a local shop and ask if you're not sure.sigpicComment

Ummm, yeah, no, Mr. Montana. The OP is from Texas (per his info)...and I stated what you can do in Texas.
Outside of a gunshow, one is legally supposed to go to go through an individual who can do an FFL transfer for private party transaction or sell/buy to/from a dealer.
And that's why they call it a "loop hole" is because in gunshows (at least in Texas) anyone can do a person to person handgun transaction without background checks, etc.
Long guns can be bought and sold privately to anyone, anywhere. It's up to you do ensure you're not selling to a felon, minor, or those with unlawful intentions.Last edited by Sailor37; 11-29-2010, 02:35 PM.Comment
