Need some advice on my truck

    Well he bought it today. Pulled out revving it and reaming on it. Called me an hour later and said he refueled it and got a water in fuel light on, he swears he put diesel in it. So I tried helping him and I guess he cranked it till he killed the starter or battery but now he said it wont crank at all and nothing works. I told him hes gonna need to drain the tank so he just said ok and left it at the gas station lol


    Keep in mind ive never had a water in fuel problem. Idk what he did but I dont care anymore.


    Oh and he also said he cant hear the fuel pump running......... its a mechanical pump lulz

    Diesel mechanic my ass.

            You do realize hes going to call you every day about this truck right? He will also probably take it to a shop where they will find out the HG is shot.

            All I can say is, I'm glad that I'm not you right now


            Btw, If someone sold me a vehicle knowing that the HG was bad and didn't disclose it I would probably be angry. Really angry. I suggest packing up all your shit and move somewhere else

              I dont feel bad at all. I didnt blow it I baby that truck it wasnt driven after he tested it. He lives over and hour away so if he wants to come pick a fight cause he cant listen to simple instructions then so be it i have his address too.

              I refuse to be out a truck cause of this guy.

                I understand where you're coming from, but I still see this as a 50/50 dick move on both sides. You should of at least told him that when he ran the truck at WOT after you told him not to that it may have caused damage.

                    I told him before. Figured that was enough. I specifically said above 1300 you will melt shit, above 35psi you will lift the head/blow shit. That head and gasket is a year old I told him over 35 psi you need to stud it at least. Of course he acts like he knew that already but I digress.

                    If I would have damaged it myself I would have told him and gave the deposit back and took a loss, but like I said I cant afford to be out 7k for the truck cause of one persons ignorance.

                        from my admittedly paranoid viewpoint, and since you asked for advice-

                        -prepare to be sued in small claims court. apparently $6000 limit in your jurisdiction; the extra $1k may not dissuade him.

                        - do this by preparing your story's talking points (ignorance of any problem the most important) in advance by writing them down. make the story plausible and learn it perfectly.

                        - see if the mods will delete this whole thread. i assume he saw a BMW in your driveway; i would learn everything i could about the defendant if were in his shoes. your user id here seems like a giveaway, maybe you should change it.

                          I would have called him up first thing I noticed the oil dripping out, flat out told the idiot that he had blown the engine up, and then go from there.

                          But now, despite the "as-is" terms, this guy has a case against you if he discovers the blown head gasket. He can accuse you of not disclosing it and take you to court. Shitty thing is you did know about it, and did not tell him... Even though he obviously blew the engine, he could deny it and probably get away with it, or you would be at fault for allowing him to test drive it in the first place without everything working as it should. I wouldn't see this ending well for you on Judge Judy.

                            As is means as is. If the guy who bought didn't realize it had a blown head gasket, then whose fault is it really. He bought a used truck and drove it away. The seller didn't say as is unless the head gasket is blown, then you can bring it back to me. If you don't know anything about what your buying you should have it inspected by someone who does. Would the seller be responsible if the guy drove it home and blew a brake line on the way? No, of course not because it was sold "as is" with no warranty.

                                here's some educaton on contracts for you-

                                Fraud Fraud prevents mutual agreement to a contract because one party intentionally deceives another as to the nature and the consequences of a contract. It is the willful misrepresentation or concealment of a material fact of a contract, and it is designed to persuade another to enter into that contract. If a special relation-ship exists, such as that of attorney and client, nondisclosure of a material fact is fraud.
