Body shop nightmare...what to do?

You dont need to lawyer up, take him to small claims court. If he wants to lose a day of business he might show up. basically at that point it'll be a judge judy type deal. but a lawyer over a 300-400 dollar valence? not worth it.

a lawyer isn't going to be able to do anything for you, esp. on a 15Y/o car part that was "broke"(in a judges eyes) suck it up and move on.

I would burn down that body shop first though!

I'm gonna give this another college try this week, except I'm heading in person instead of chasing phone calls to a guy that won't call me back. I'm getting to the bottom of this.

in California leaving the bumper with the first shop would have created a bailment- the first shop is responsible to return the bumper to you in the condition they received it. the only argument as to this responsibility is that you in fact did not leave the bumper with him. the second shop has no liability to you. or, at most the two shops could be found to be jointly and severally liable.

your course of action, in Ca., wouild be simple. Small claims action against first shop for the amount you paid for it plus court costs. if you still have the text messages they would probably be admissable as evidence in small claims. subpeona the person at the second shop who told you they did receive it from the first shop. his testimony would eliminate any doubt the first shop did receive it from you.

whatever you do, don't buy into the BS above about "you lost, move on". sue the bastard.

Thanks for the advice.

Failing to have any recourse on the value I paid for it,(I believe it was 300ish) texts are long gone, was found on a Craigslist add, seller is non-existent to me.

The only closest value I can render is the later model valence..mine was the earlier valance, PLUS I had e30 M3 fog lights installed in the assembly. (Those I bought from FCP Groton for about $200)

Perhaps take a portion of the amount of the valance from racing dynamics, plus the cost of the fogs from either realoem or FCP would amount to a settlement value.

I'll show up in person Tuesday, equipped with printouts, and go from there. If I don't walk away with a cheque or cash I will proceed with small claims court.

I don't see how this won't work as it's 100% their fault.

Just reading this got my pissed as fuck! I would walk in there with a 12 gauge loaded with slugs and start painting the walls.
