    Every lease I've seen says you lose your security deposit if you break the lease, just make sure you notify him (letter/email) that you intend to break the lease so he can't try to come after you for unpaid rent.
    This is technically illegal as far as I know as a land lord you can not be "paid rent" twice for the same month.and keep both payments. Though I suspect this was a case of "paying a penalty" for breaking the lease a month early to avoid such issues and get to keep the windfall

      i'm in similar situation and trying what to do. our deposit was one month's rent, so to me, if we lose that deposit, but gtfo of here when we want to, that's cheap and you should just take the deal and run. however, if your deposit was much more than 1 month rent, you should try again to line up a replacement tenant.

        Yeah, they didn't have to pay the last month's rent, but lost their security deposit for sub-letting to me for the last month. So in essence, they could have paid their last month's rent and had longer to move out, but I guess there was no guarantee that they'd get their whole security deposit back.

        I dunno, It worked out for me because I needed to be in there a month before their lease ended.
