Wow, and I thought BH cops were weird for letting residents go to keep BH's profile clean with few tickets/arrests. The only people I see stopped are latino or black. One girl at my school was 'tipsy' with a drunk friend in the passenger seat, she made an illegal u-turn, got pulled over, admitted they were drinking, and the cop let them go.

your description sounds factual and honest.

"I didnt feel it was necessary to stop since I was not in violation of any law"

bottom line is if the cops tell you to stop you are required to whether youre on private property or not.

"Since I wasnt under arrest for any charge I refused to put my hands behind my back."

this is where it all went south.

a lot of cops are on power trips but if you comply and do as they ask youre not going to get fucked with.
i seriously doubt youll get anywhere with this. you know as well as i do this shit happens everyday. and courts have seen millions or sworn statements from the victims buddies claiming total innocence.
the cops will claim you resisted arrest and they will get the benefit of the doubt. its just the way it works.
again, sorry you got worked over and sprayed
Actually as I understand the law in WA, a cop can "detain" you and handcuff you before they charge you with a crime and are then required to read you your miranda rights. Not saying the cops weren't in the wrong here, but they can handcuff you and search you "for their own safety" before you are charged with a crime. I found out the hard way, too.

          Good luck bro.

Im getting signed statements from all the 7 witnesses and sending them to my lawyer. I am not backing down. I walked out of the car, they did not have any lights on, they didnt say anything until I was almost to the door. I didnt feel it was necessary to stop since I was not in violation of any law and the WHOLE driveway and the patio is private property. Then I stopped just short of the door and asked what we were being stopped for and or what was the charge. They refused to answer. Then he grabbed my arm very hard. Throughout I was asking politely (with no cussing whatsoever) what was the charge. No answer. Since I wasnt under arrest for any charge I refused to put my hands behind my back. Had they told me what the reason was for fabricating this arrest I would have happily put my arms behind my back. I suppose in their eyes, they can cuff you and arrest you, but not tell you the charge. There was no arrest to resist. They then proceeded to try and trip me which led to them dragging me out and slamming onto Mikes car twice and with me already subdued they went to town with the pepper spray. When I was in custody and I was being interviewed, I was calm, polite, articulate to every and all officers that I spoke to. SHowing that if one treats me with respect, I will reciprocate. The point is this, fellas. Ive been through everything, and the times I SHOULD have been locked up for cussing at cops and telling them to fuck themselves and instigating stuff, nothing happened. I literally did nothing to provoke them and wasnt violating any law, looking suspicious, hiding anything. I was wearing the shoes I always wear (Koston ES's), A Bimmerfest shirt of all things, and some shorts with skater glasses on my head. But thats besides the point or else now were heading into racial profiling territory. I had my friend drive specifically to be on the correct side of the law. I did not run into the house, I calmly started walking towards the door. I was going to be off probation in August, havent been arrested since 2003, I have paid ALL my fines, completed ALL programs, done ALL community service and have no outstanding warrants or court dates. I was looking forward to being free and clear of legal obligations for thge first time since I was 17. Now this...... Im not taking this lying down.

Good for you Mariano! Don't you dare back down. You've been in the wrong before (as have I) and took it like a man. Now it's your turn to dish it back out.
I agree with Blunt however, not all cops suck.
Everything that happened to me in the past was due to my neglegence, I knew that skateboarding (just like speeding) was illegal in the city of Atlanta and I was willing to take the chance. I mostly got off scott free, but then again when I got ticketed I didn't bitch about it, I took my punishment. I have been ripped off my board by a motorcycle cop downtown doing about 20 mph on a sidewalk. It sucked, but I was breaking the law no matter how useless it may have seemed at the time. I wasn't even grinding or sliding, I was skating to my car, but it was still against the law.
I have on many occasions met and dealt with extremely professional police officers and have nothing bad to say about them at all.
The ones I have run into that were unprofessional however were the worst. I still don't hold it against the ones I have met in the past.

I will be more than happy to email whover it takes to make sure things are right. And I am sure 99 percent of the people on this forum support you on this man!
              Good luck.

I did indeed win. Not guilty. Cop looked rediculous on the stand. He got many key facts wrong and inaccurate that he himself wrote in the report. Inconsitencies. No bullshit. Ian Im sure if you ask the people on this board, youll find out Im not the type to spout nonsense. ;)

Good for you and sticking it to those dickwads that F'd with you.

That said, I have yet to run into a "bad" cop, but then again I live in South Orange County.

Good for you man! I'm quite surprised that they ended up charging you in the first place? I have seen similar situations where the cop was in the wrong (he knew it himself) but even so ended up laying a charge just so he didn't appear foolish by backpedaling at the scene. In the end its a waste of a lot of time money. Any chance of the CF hood being paid for?...

                            Didn't think so.

Congratulations, it must be a huge relief to have that over.
Cop's can be fucking annoying but 9 times out of 10 they're just doing their job,
I'd say i get pulled over at least once a week here, for a "random" breath/drug test,
just because i drive a loud "flashy" car with P plates on it (P=probationary driver... 18-21 yo's)
It's complete bullshit, but they're usually polite, and if you comply you'll drive away with nothing but 5mins of your life gone.

Staying calm, and sticking to facts, is always the best option when dealing with the police.

When it comes to cops, one thing I try to remind myself of is that in the instance of a very bad car crash, it's likely that they're going to be the first ones on the scene. So, if one day some asshole in his Ford Superduty runs a red light and T-bones me, causing me massive bodily damage, my life could suddenly be in the hands of a cop and his first response training. I just couldn't imagine what it would be like to be a cop sometimes.
