    Speeding ticket FTL

51 in a 35... lame. :) Yeah, wasn't paying attention going to work and saw a cop whip a 180 in my rear view. Also he happened to mention that my inspection expired in 2002. Oops. :)

It's the first ticket I've gotten since around '04, my record is (or was) clean up until today. Anyone got any ideas what they'll do to me? Court date's the 13th of March, I plan on just pleading no contest and hoping for a PFJ. Fine was $50 with $120 in court costs, which is bullshit but it could be worse so I'm not going to complain.

"See, we're adding a little something to this month's sales contest. As you all know, first prize is a Cadillac Eldorado. Anyone wanna see second prize? Second prize is a set of steak knives. Third prize is you're fired."

      Here I think it's $10 for 0-5, $30 for 6-10, and $50 for 11-15 over UNDER 55mph.

Over 55mph it's a whole different ball game, I think fines start in triple digits there.

Court costs are what get you in NC apparently.

Check the area in which your were "clocked"

In Georgia the law states that speed detection devices cannot be used within 300 feet of a "Speed Limit XX" sign (600 feet out of city limits).
Also, in Georgia, if the grade is over 7% speed detection devices cannot be used.

Burden of proof is on the prosecution in any state, so the police officer (state) would have to prove there was no limit sign (not to hard to do, but if you were near one...) or that the road was not that steep (also would probably be information that is easy to find in road engineering records...)

With some knowledge and brass balls (being in front of a judge is scary shit) you can have the case thrown out, or at least put up a fight.

This country is a democracy. If the justice system is not kept in check the rules can too easily destroy the people. So fighting something as simple as a speeding tickt, in my opinion, conserves democracy in America.

Honestly man, I don't plan on fighting the ticket. It's not worth my trouble. I'd rather just say "my bad" and accept that fact that no matter how it goes I still have to pay $170, whether or not it goes on my record. My insurance isn't that expensive anyway, worst case scenario if my premium doubles I'm only paying $60 a month on the E30. Woopdy.

Psst... Get a lawyer. I've always gotten one, but then again I'm a young gun and I don't trust NC laws.

I can recommend you a good one: Russel Dement, III.
Me: "I can't wait to redline my car!"
Mark: "Didn't you just break a rocker arm?"
Me: "Yeah, I don't think I've learned my lesson."
              Mark: "You never will."

I love it when non-lawyers start spewing shit they read on the internet about "300 feet from a speed limit sign" etc etc. Let me know how that stands up in court for you. The cop will say he measured it out and he was over 300 feet away.

Matt, if NC is a points state and this ticket hurts you, see if you can get the prosectuor to amend it to a no points violation. The other alternative is if you are allowed to do a traffic school in lieu of conviction to avoid the points. Here, traffic school is a 3 hour evening BS deal. Dunno about other states. Some states, like Ohio, will only let you do school if the points from the ticket in question will put you in a suspension.

Maybe Kentucky cops are smarter than GA cops.

You don't have to be an attorney to know the laws that govern your life. I think citizens that do not know the law are ignorant.

I should just put esquire behind my interznet name that way i can be legit.

                      I don't doubt that.

That is a nice lofty aspirational thing to say, but the fact is, no one knows all of the law. But it amazes me how much BS is floating around out there on all of these supposed "technicalities" that will get you out of a ticket.

How do you plan on proving the exact grade of the road - gonna hire a surveyor at a ridiculous cost?

The fact is 99.50% of the tickets are deserved and you just need to know how to minimize the pain.

Given my clean record I have a good feeling they'll be lenient. I'm going to speak with the DA on Monday and explain what happened and see what he can do for me, I'm good friends with an ADA's daughter. I may see if the prosecutor could help me out as well. NC pretty much requires you to attend traffic school after 7 points and suspends your license after 12, but there may be an option to take one if they decide to give me the points. I think there's even an online one I can take, haha.

And yeah Julien, my friend whose parents are both cops already corrected me on the PFJ/PJC thing. :) I was just surfing the internet and it's listed with a hundred different abbreviations (PFJ, PJC, PBJ, PBJC, etc.)

No. Don't do this. Outside of Cali, this is 100% useless.
