    Haha, guys, I'm NOT going to fight the ticket. I'd rather just plead guilty and take the two points than worry about all that bullshit.

    Not to mention I deserved what I got the ticket for, and I would much rather go on record as being 100% truthful about the situation rather than trying to BS my way out of it.

      Who ever said this came from the internet? And yes it works, i have done it twice. The defendant has nothing to prove, burden of proof is entirely on the state. So yes, it behooves the defended to cause the state to take further, expensive, action.

      How do you plan on proving the exact grade of the road - gonna hire a surveyor at a ridiculous cost?

      The fact is 99.50% of the tickets are deserved and you just need to know how to minimize the pain.

        Lawyer talking here.
        call the traffic court clerk see if there are hours to talk to the prosecutor to amend or divert.
        Go to court on date of ticket and ask to amend the citation if you can't talk to them before.

        Usually city's want the $$$so they will double the fine and so you would be looking at $220 and they will change the ticket to inattentive driving shit i did two tickets last week like this back to back days in the same county.

              Kyle, STFU. The Georgia "road grade" defense is just that - and it is not the law in most states. It is an affirmative defense that YOU must prove. The state need not prove the road grade to make their case. They must merely prove that you were speeding. The burden shifts to you to show otherwise.

              Just like arguing the cop was too far away or had an obstructed view - you are going to have to prove those things. He does not have to prove a negative - that is that his view was unobstructed - you have to have the proof he did not have a clear view of you.

                  I said nothing about obstructed view. All I said is that speed detection devices cannot be used within set boundaries of speed limit signs. For an attorney your reading and comprehension skills are lacking...

                    40-14-7. Visibility of vehicle from which device is operated


                    No stationary speed detection device shall be employed by county, municipal, college, or university law enforcement officers where the vehicle from which the device is operated is obstructed from the view of approaching motorists or is otherwise not visible for a distance of at least 500 feet.

                    40-14-6. Warning signs required


                    (a) Each county, municipality, college, and university using speed detection devices shall erect signs on every highway which comprises a part of the state highway system at that point on the highway which intersects the corporate limits of the municipality, the county boundary, or the boundary of the college or university campus. Such signs shall be at least 24 by 30 inches in area and shall warn approaching motorists that speed detection devices are being employed. No such devices shall be used within 500 feet of any such warning sign erected pursuant to this subsection.

                      40-14-8. When case may be made and conviction had


                      (a) No county, city, or campus officer shall be allowed to make a case based on the use of any speed detection device, unless the speed of the vehicle exceeds the posted speed limit by more than ten miles per hour and no conviction shall be had thereon unless such speed is more than ten miles per hour above the posted speed limit.

                        40-14-9. Evidence obtained in certain areas inadmissible; use of device on hill


                        Evidence obtained by county or municipal law enforcement officers in using speed detection devices within 300 feet of a reduction of a speed limit inside an incorporated municipality or within 600 feet of a reduction of a speed limit outside an incorporated municipality or consolidated city-county government shall be inadmissible in the prosecution of a violation of any municipal ordinance, county ordinance, or state law regulating speed; nor shall such evidence be admissible in the prosecution of a violation as aforesaid when such violation has occurred within 30 days following a reduction of the speed limit in the area where the violation took place, except that this 30 day limitation shall not apply to a speeding violation within a highway work zone, as defined in Code Section 40-6-188. No speed detection device shall be employed by county, municipal, or campus law enforcement officers on any portion of any highway which has a grade in excess of 7 percent.

                                I re-read my posts and I never called you stupid or said you were "lower" than anyone.

                                If I need to get puke stains out of my alcantara seats in my 5er, I know who to call. And if someone else does, I won't come on here and spout my internet knolwedge and try to dispute that someone like you in the business of stain removal and cleaning knows better than I do, as they probably do.

                                But if a member needs traffic ticket advice, don't be upset if you are not considered the best authority on the subject.
