^^^ SO when is someone going to post the Rodney King video?
Not ALL police are out to get you. If anything, you shouldn't talk to the police when you've done something wrong. THATS good advice.alexw

If you're already being arrested, then absolutely shut your mouth. But according to my former attorney it is never a good idea to refuse the official BAC test AT the station. And of course, if you are arrested, if you do speak, you do it after consulting with an attorney.
But there are situations where you may or may not get arrested, and if you behave like a rational person (while not incriminating yourself) and just speak with the officer, they will be less likely to arrest you than if you are either a dick or a mute.
Basically, you just have to be smart about what you say.

There are good cops out there.
If you're not an asshole in the first place they wont fuck with you. And if you know you're innocent, get the bullshit over with and when they find nothing, point it out to them.Your signature picture has been removed since it contained the Photobucket "upgrade your account" image.

And cops dont always have probable cause. I was out cleaning my car in my own neighbourhood and cop came up to my friend and I demanding to search our cars because there were reports of someone with a gun. I told him no and he attempted to detain me. I called my neighbour over, his boss, and left for work. Had I not known his superior personally I very well might have been thrown in the back of a police car for some bullshit charge because some woman misstook an airsoft for a real pistol.
Edit: I remembered I also had to call Fields (my neighbour) to keep from being arrested for vandalism while playing frisbee in the parking lot of a city park. Even though they didnt arrest us they detained us for an hour and 45 minutes.Im now E30less.

I wonder if the people you see on COPS ever get a break by agreeing to be on TV and/or signing a release once they are booked. Most times the cop will tell the suspect about his right to remain silent and then persuade him to spill his guts. And then when they take the guy away in handcuffs, you sometimes hear the cop say, "Hmph.. he shouldn't told me that. I was about to let him go."

Your friend was in the wrong from the get-go, so I'm not sure what your point is.
You should be saying: "If you're going to drink and drive, be prepared to go through the motions." Not: "If you're going to refuse the test, be prepared to go through the motions." The fact that he refused the tests had nothing to do with his arrest. In fact, only good things could have come for your friend had he taken the test. The officer already had enough to arrest him, and had he been a reasonable person and taken the test, he may have been able to prove that he was not too intoxicated. So why not take the test in that situation? If you do fail a BAC test at the scene, that evidence is not admissible in court (at least in my state). Only the real tester at the station, or a blood test is admissable evidence.
And FYI, there is absolutely no legal ramifications for refusing a field sobriety test or BAC test prior to being arrested. You can tell them to shove it up their asses. And if they have no "reasonable doubt" then they absolutely cannot arrest you. If you smell like alcohol and are a dick to a police officer, they will take you to jail; and they should. It's pretty simple.
I wish I had known a bit more about shit like this when I was younger. My attorney told me a while ago that if a person (not me because I wouldn't drive intoxicated) were to get pulled over with alcohol on their breath, that they can crack the window, give their driver's license, proof of insurance and registration to the officer and roll the window back up. Again though, if they can find any other reason to bust you when yo do something like that, they will.
Okay, I think I need to go to bed or something.
Wait, LMAO at you saying, "In fact, only good things could have come for your friend had he taken the test."
He'd still be performing community service, visiting and paying probabtion, paying a 3 year annual surcharge to the state of $1,050 per year etc... OH YEAH!!! Only the good things in life!
Every single friend of mine can easily enjoy several pints and be able to drive in a more orderly fashion than most sober people can. Take that however you want; it's only to setup my point. A few pints takes you well over the legal limit here in Texas. It takes you over the legal limit! It does not cause you to commit traffic violations, damage property and/or bodily injury. So where is the crime if not only passing a limit set to almost a bier and a fraction of another? That is a bullshit law IMO. People are going to get fkng hammered and drive all day long everyday. The current law as well as many other laws just end up making alot of people's lives miserable. Most of us are to used to being governed to question alot of the shit that takes place such as certain laws.
EDIT: if your attorney told you it's never a good idea to refuse a BAC then I would simply suggest, run away from him and never look back! By shear common sense, where does guilty beyond a reasonable doubt come in without you speaking, taking a field sobriety test and a BAC? Seriously? Now you tell me, how is it not a good idea to refuse a BAC?Last edited by Maluco; 07-15-2008, 07:28 AM.

The law is clear. And is not over ambitious. Loosening this law isn't going to make people be more responsible. So tighten the noose and make it hard on drinkers.
Your friend is the reason many cops are assholes to people.
He was guilty and still got away with it. That sucks.
OUTRAGIOUS!!!! You mean they want people to take responsibility for their actions???????Your signature picture has been removed since it contained the Photobucket "upgrade your account" image.

Unless they saw me steal something, they don't have a right to detain me. If they stop me, the first thing that I ask them is whether I am under arrest. If they say "no" then I leave without further discussion regarless of how many times they yell "Sir, PLEASE COME BACK" If they persist in attempting to detain me, I threten to sue for false arrest.
Think about it before you act like a cowboy next time, it's up to us as well as the retail stores to hinder theives.Yours truly,

You should always cooperate with LPS in retail stores, it deterrs real theives.

In Canada you're considered detained when you feel that your freedom has been revoked. So if a police officer is talking to you, and they won't let you leave then you're considered detained.1985 325e 2.8 Turbo VEMS

He was guilty? Really? By your terms? Thank God for the due process clause of the FIF.
