        AZ, OK, FL have similar propositions on upcoming ballots.

        Unfortunately unless the Healtcare law itself is deemed Unconstitutional, most judges would likely strike down MO's and others laws using the "Supremacy" clause of the Constitution.

                  It was changed to a tax because according to the constitution you cannot require healthcare as part of citizenship which is why this whole thing is unconstitutional.

                    It was changed to a tax to try to get it to fall under the Interstate Commerce clause, which IS something Congress has specific enumerated powers to control.

                      It has to be a tax to levy it on to the public. If its not a tax then there is no way for them constitutionally to force you to pay.

                      THATS WHY ITS A TAX, and IIRC some of us were pointing this out long before the thing was passed

                      Federal judge wanting to make a name for him self will just nullify it, Just like the one on CA did to day with the Prop 8 Gay marriage ban that was passed by ballot proposal.

                      If I could just get MT to get on board with this shit, because its so unlike the mentality of the population (other than some of the recent imports from more progressive states) to allow the govt in like this, But too bad the senior senator from my state is the Grand poo-baa for the HC bill and wrote much of it and has been banging on it for years.

                          Yup we all know that, but for it to stand a snow balls chance in Bermuda of surviving a court challenge it has to be a TAX to fall into the interstate commerce clause's scope of relevance, to there for be collected legally. Even though the entire legislation is built on a house of cards, and dressed with smoke and mirrors as far as the Constitution goes.

                              I just spent a week on a dive boat in Hawaii and one of the other divers was rep Bob Williams from WV. The first thing he said after his wife ( total waffleswaffleswaffleswaffles BTW ) outed him as a rep was "what a job, sit around and get paid to do nothing", I had a quick comeback with " Bob the people would be better off if you did nothing "
