Travis; put on a shitty attitude about what was offered and, start raising hell.
What I mean by that is, that you no longer want to speak to the adjuster (clain rep), so you skip'em and ask for the supervisor.
You tell them how offended you are about their offer and that because of this accident, you have lost wages (have you gotten a rental?), rental fees have not been racked up and that you "don't want to use an attorney" to settle property damage.
Threaten to include the insurance co. and insured in a lawsuit because of bad faith to settle your claim for an accident/damages their insured caused.
I'm sure you've heard it before but it is all in the wording.

In a limit of liability claim the insurance company needs to decide whether to pay everyone or no one. If they've given any payment to another party then you have grounds to raise hell. It sounds like they're splitting whatever money is available and offering it out...if everyone accepts then everyone gets a small cut. I don't think a lawyer is going to take on a parked-and-unattended PD only claim though. I would write the handling adjuster a no-margins 10-pt letter itemizing any and all violations and fax, email and mail it to them. Adjusters hate mail.1989 325is / 2.7, 274 cam, e30 M3 5-lug

at this point, that is what i'll have to do. i'm just so scared of not getting anything...
so take the guy to small claims and ask for 7500? or ask the insurance for that. they'll laugh because they had 10k to spend among 4 parties. i know for a fact the car that hit me from behind is already been fixed and that means the insurance already paid the 5k bill to that guy's insurance.
i've called and asked what my next step was, get a lawyer? which was a month or two back now and she told me should wouldn't know. i don't think they are all that phased by that.^yup. Or hire a lawyer on probate. Insurance companies have a chain of command are like robots. They will always offer the least and hope you take it. If you get a lawyer I guarantee you they will want to settle more quickly once you start claiming other damages, lawyer fees etc
2k? that won't even cover the damn side of the car, let alone the massive damage in the rear...take the money and run, small claims court is nearly impossible to get your money. they either can take YEARS to pay you or just file for bankruptcy. Happened to my girlfriends parent's.. The were being ran around for 6 months, and in the end - the dude just filed for bankruptcy.. They didn't get jack shit but a , sorry.
thanks, i think that might be a smart idea. i never got a rental because i'm not 25 years old and every rental company wanted a minimum of 800 not including taxes and whatnot for monday-friday rental. that ain't coming out of my pocket. it's been more than 3 months. i'd be working just to pay for a rental. i was forced to call my parents and have them come pick me up and drop me off at work for 2 weeks until i said fuck it and "fixed" my car up enough to drive. i know for a fact the damage to the car is worth a helluva lot more than what she estimated. in fact, it probably exceeds the kbb value, which sucks because i have so much money invested in the car from me alone that can be proven with receipts and that's not including previous owner(s).Travis; put on a shitty attitude about what was offered and, start raising hell.

i'm so sick and tired of this bullshit insurance company. i seriously would have been better off if someone stole my fucking car.

@Mike; valid points bro and you're right, no attorney is going to accept PD only claims. With that said, I'm only talking about scare tactics, alot of times they work.
We did that for one of my brother's old prelude, worth about $1600 market value and got $3600 including rental fees and loss of wages., the accident was similar to Travis's, parked and hit by a drunk driver who fled the scene.

Legal assistant: Signing up new bodily injury cases, (auto accidents/workers comp) prepping all of the paper work, set up adjuster evaluations of property damage, settling that part and referring clients to various dr.'s. Ultimately have the file ready for the attorney to start the negotiation part of it or prep the paper work for litigation, which was not fun at all.
