    they either have to pay everyone or no one. you can't get coverage you didn't purchase....otherwise everyone would buy state minimum $5k PD

          If the guy only had 10k coverage then the chance of him having the money to payout on a law suit is pretty low

              that's exactly what i'm afraid of. i don't want to be in a small claims battle for months, even years. i just want to get my money, save it, leave, and when i come back have some bitchin car(s).

                          Btw travis I am not sure on amount but if you take the guy to small claims court, assuming its still within the small claims limits, it should be a scheduled date which will most likely be within the next month or two, and it will get decided then and there, if they garnish their wages it starts immediately, if they dont show up, a warrent goes out for their arrest and you may have to reschedule but now you have the upper hand

                            thanks chris, that's very helpful. i may take him to court then. i can't take such a large loss like this. my car is totalled and there's no way in hell 1900 will even come close to the amount to fix just the side of the car. i guess i'll be sending in a decline letter.

                              I'd take him to court for sure. Shit I'd do it just based on principle of not letting him get away with it.

                              What I want to know is why can't you take the offer AND sue for the rest?

                                I assume that this letter is from their insurance company. Release of liability would prohibit you from seeking further action against them and their client. I may have missed something but years ago I had a similar experience and ended up going through my insurance company to get paid and let them chase the deadbeat.
