That car is just a cruiser now no chip-no cam. But no loud exhaust = wife will ride with me now to meets :). Loud exhaust is in the silver e30. :twisted:

thanks chris, that's very helpful. i may take him to court then. i can't take such a large loss like this. my car is totalled and there's no way in hell 1900 will even come close to the amount to fix just the side of the car. i guess i'll be sending in a decline letter.

A verbal or email should suffice. I did the small claims thing...the garnishment of wages packet is 70 pages long and you have to take about 6 months of steps before you can do that - at least in arizona. I have an outstanding judgement in my favor for nearly $2k 3 years ago and I've collected about $150.

I'd take him to court for sure. Shit I'd do it just based on principle of not letting him get away with it.

What I want to know is why can't you take the offer AND sue for the rest?

That's how they're protecting their client within their limits...offer an easy split in exchange for indemnity.
