            Unless the person filing the civil suit is a 'tard though, I'm guessing something shady went down, either intentional or with intent. Otherwise it'll get thrown out when the OP stands up and his only argument is "I don't like it!"

            Perhaps not though. I'm guessing we get to wait months now for this thing to resolve, and we'll only ever find out the conclusion if the OP wins.

                  I'm trying to read between the lines of what OP has said and if i'm reading it right,then OP sold car to friend on payments and kept the title,Op may or may not have a title showing himself as leinholder,which makes a difference to the court.

                  If OP has a title showing himself as leinholder,then the tow company has different responsibilities to take possesion through the lein process,If they followed the process and the leinholder didnt take action then the leinholder has no recourse left unless the tow company didnt follow the law properly.
                  If the OP has a title showing himself as owner and he didnt take action to recover his property from the tow company then the tow company has every right to recover his money by auctioning off the vehicle,AND he may come after the legal owner for additional money that he is owed until his lein is satisfied.
                  If the tow company has satisfied the state requirements then he has every right to sell the vehicle at auction and THAT sale is legal and binding and the buyer IS the new legal owner,he gets a NEW title,and any old titles are void.There are not 2 valid titles issued by the state.The new owner has no responsibility to any former owners or leinholders.
                  If the OP is owed money by whoever he sold the car to then he can still go after that person for whatever is due him but he probably cant recover the property at this point.

                                That was Dan and his white E30, he moved to spokane and needed a winter car. I still have my 89 zinno and plan to start the S50 swap in february!
