If the car has SLS, you'd be wise to fix the tailgate ASAP so it doesn't let the cavity fill with water/humidity and destroy the SLS pump. Just went through that on an '03.

Interesting. It leaks a little bit when I was at the car wash but it's not horrible. Based on the rust its been like that for a while. Thanks for the info! Now I'm on the hunt for a E39 Alpineweiss Tailgate!

Pop the huge cover off (it looks like half a pumpkin) - check the sound insulation on the underside to make sure it's not waterlogged.
Also check left lower corner where the glass is on the rear gate of any replacement hatch you buy, they rust out there and will also drain water into the pump cavity.
